User Terms of Service

Article 1 (Purpose and Application)

  1. These Terms of Service (hereinafter referred to as "these Terms") apply to all relationships related to the use of the service provided by JP Consulting Inc. (hereinafter referred to as "the Company") for searching and discovering real estate through the "Platform" (hereinafter referred to as "the Service") by those who use it (hereinafter referred to as "Users").
  2. These Terms set forth the conditions for using the Service. Users may only use the Service in accordance with the conditions set forth in these Terms.
  3. The Company may separately establish compliance items applicable to all or part of the Service (hereinafter referred to as "Individual Terms"). Unless otherwise specified, Individual Terms form a part of these Terms. In the event of any inconsistency between these Terms and the Individual Terms, the Individual Terms shall prevail.

Article 2 (Agreement to the Terms)

  1. Before starting to use the Service, Users must thoroughly read and fully understand these Terms, Individual Terms, and the Privacy Policy, and commence use of the Service only after doing so. The actual commencement of use of the Service by a User shall be deemed as the User having read in full and fully understood these Terms, Individual Terms, and the Privacy Policy, and having given a valid and irrevocable agreement to all of them.
  2. The Service is available only to those who are 18 years of age or older. Users under the age of 18 are not permitted to use the Service. If a User who was under the age of 18 at the time of agreeing to these Terms uses the Service after reaching 18, it is considered as ratification of all their actions taken while under the age of 18.
  3. If a User uses the Service on behalf of a business, it must be used under the agreement of the authorized representative of that business.

Article 3 (Changes to These Terms and Individual Terms)

  1. The Company may, without obtaining the consent of the users, change these Terms and Individual Terms from time to time under any of the following circumstances: (1) When there is a change in name or formal expression, correction of typographical errors, or other changes that do not affect the substantive content of these Terms and Individual Terms. (2) When the change of these Terms is in the general interest of the Users. (3) When the change of these Terms does not contravene the purpose of the contract, and is reasonable in light of the necessity of the change, the appropriateness of the content after the change, and other circumstances related to the change.
  2. The amended Terms and Individual Terms take effect from the time they are notified to or made known to the Users by posting on the Service or other methods deemed appropriate by the Company. If a User uses the Service after the change of these Terms and Individual Terms, or does not take the procedure of cancellation within a reasonable period (or within a period prescribed by the Company, if any), it is deemed that the User has fully understood and given a valid and irrevocable agreement to the content of the changed Terms and Individual Terms.
  3. When using the Service, please refer to the latest version of these Terms and applicable Individual Terms from time to time. The Company shall not be liable for any damages suffered by Users due to changes to these Terms.

Article 4 (Account)

  1. When registering information about themselves for using the Service, Users must register true, accurate, and complete information and must always update it to keep it current. The Company is not responsible for any damage suffered by Users due to failure to update account information.
  2. Users must promptly update their account information on the Service in the event of any changes to the following: (1) Name or company name (2) Name of representative (3) Nationality, place of residence (4) Contact information such as telephone number, email address, etc.
  3. The Company may delete a User's account at any time without notice if the User falls under any of the following: (1) If the information registered is false or inaccurate (2) If the User has previously been subject to suspension of use, cancellation of registration, or similar measures due to violation of these Terms (3) If the Company reasonably determines that a provisional registrant belongs to or is associated with anti-social forces (4) If one year has passed since the last access to the Service (5) In other cases similar to the above, or if the Company determines that it is inappropriate for the individual to be a User
  4. Account information and User status in the Service may not be licensed, lent, transferred, sold, or provided as security to third parties.

Article 5 (Management of ID and Password)

  1. Users are responsible for managing their ID and password (hereinafter referred to as "Login Information") provided by the Company. Users must strictly manage and store their own Login Information and must not license, lend, transfer, sell, or provide it as security to third parties.
  2. Users bear all responsibility and liability for damages due to insufficient management of Login Information, misuse, or use by third parties, except in cases of intentional or gross negligence on the part of the Company.
  3. Users are obligated to change their passwords regularly and the Company is not liable for any damage to the User or third parties due to failure to fulfill this obligation.
  4. All actions taken using a User's Login Information will be deemed as actions of the User holding that ID, and the Company is not liable for any damage to the User or third parties, except in cases of intentional or gross negligence by the Company.
  5. Users must immediately report to the Company if their Login Information is leaked, lost, forgotten, or if it is found to be used improperly by third parties, or if there is a possibility of such. In such cases, the User must comply without objection to instructions from the Company.
  6. The Company is not liable for any damage to Users due to theft, loss, or other incidents related to Login Information.

Article 6 (Conditions and Restrictions on Service Provision)

  1. Users are responsible for providing and maintaining, at their own expense and responsibility, the communication equipment, operating systems, communication methods, tools, applications (including those listed below, whose names and URLs are subject to change), and other environmental and facility requirements necessary for using the Service. The Company has no obligation or responsibility to assist, whether paid or unpaid, in setting up such an environment.

  1. Users are responsible for connecting their equipment to the internet using telecommunication services provided by telecommunication operators or others, at their own expense and responsibility.
  2. Even if there are issues with the environment and facilities mentioned in the preceding two paragraphs, the Company has no obligation or responsibility to provide support or any other services related to the use of the Service, whether paid or unpaid.
  3. The Company may limit the provision of all or part of the Service to Users who meet certain conditions deemed necessary by the Company, such as age, identity verification, registration information, explicit agreement to these Terms, Individual Terms, Privacy Policy (including those amended), or other conditions.

Article 7 (Display of Advertisements) 

The Company may post advertisements of the Company or third parties on the Service by any method at its discretion.

Article 8 (Interpretation and Other Services)

  1. Users may use the interpretation and translation services (hereinafter referred to as "Interpretation Services") provided by the Language Support Center, a business partner of the Company, only if the real estate agent member matched on the Service (hereinafter referred to as "Agent Member") has concluded a contract for Interpretation Services with the Language Support Center.
  2. The contract for Interpretation Services is between the Agent Member and the Language Support Center. The Company is not involved in this contract and does not guarantee that Users can use the Interpretation Services. The Company is not obligated or responsible for resolving any disputes or troubles between the User and the Language Support Center or between the User and the Agent Member that may arise from the use of Interpretation Services.
  3. The Company is not responsible for any aspect of the Interpretation Services used by the User. The User assumes all risks and responsibilities for using the Interpretation Services. By using the Service and the Interpretation Services, Users are deemed to have understood and agreed to these risks and responsibilities. Furthermore, Users must comply with the terms of use and other regulations set by the Language Support Center when using the Interpretation Services.
  4. Even if damage (including but not limited to losses and damages arising from disputes between the User and the Agent Member) occurs to the User due to the negligence of the Language Support Center, all responsibility for the Interpretation Services lies with the Language Support Center, and the Company bears no obligation or responsibility.

Article 9 (Compliance)

  1. When obtaining or possessing personal information through the use of the Service, Users shall comply with laws and regulations regarding the protection of personal information, guidelines of the Personal Information Protection Commission, and other norms.
  2. When the Company requests a User to stop any unfair or inappropriate actions, provide information regarding such actions, or make improvements, the User shall comply with these requests.
  3. Users shall not use the information obtained through the Service beyond the intended use of the Service (including copying, transmitting, reproducing, modifying, etc.), nor shall they provide it to third parties.
  4. Users shall respond promptly and sincerely to inquiries from Agent Members, other Users, or the Company.
  5. Users shall not disclose secrets of others obtained through the use of the Service without a legitimate reason.

Article 10 (Responsibility for Information Dissemination and Disputes with Third Parties)

  1. Users are solely responsible for the information they disseminate through the Service (including but not limited to communications with Agent Members or the Language Service Center) and shall not cause any damage or burden to the Company. If the Company suffers any damage or burden, the User shall immediately compensate or reimburse the Company for all such damage or burden.
  2. If a User causes damage to a third party or is involved in a dispute with a third party in connection with the use of the Service, the User shall resolve it at their own expense and responsibility and shall not cause any damage or burden to the Company. If the Company incurs any damage or burden, the User shall immediately compensate or reimburse the Company for all such damage or burden.
  3. The Company may check the content of information disseminated by Users if necessary to verify compliance with laws and these Terms and Individual Terms. However, the Company is not obligated to conduct such checks.

Article 11 (Prohibited Actions)

  1. The Company prohibits Users from engaging in the following actions when using the Service:
  1. Acts that violate laws (including ordinances), court judgments, decisions or orders, or legally binding administrative measures
  2. Infringing or potentially infringing on the intellectual property rights, patent rights, utility model rights, design rights, trademark rights, copyrights, rights of publicity, or other personal or property rights of the Company, licensors, or third parties
  3. Commercial use (profit-seeking) of the Service or information/services posted on the Service, except as authorized by the Company
  4. Acts that unfairly harm the honor, rights, or credit of others
  5. Acts contrary to public order and morals or providing information that is or may be contrary to public order and morals to other Users or third parties
  6. Criminal acts, acts leading to criminal behavior, or promoting such acts
  7. Acts of business, advertising, promotion, solicitation, religious activities, soliciting for religious groups, seeking sexual acts, seeking relationships or encounters with unknown persons of the opposite sex, harassment, defamation, discriminatory acts, or other uses of the Service for purposes not intended by the Service
  8. Registering or providing false, potentially false, or inaccurate information on the Service
  9. Unauthorized access to the Company's system, alteration of program codes, cheating using application specifications, distributing computer viruses, or other acts that obstruct the normal operation of the Service
  10. Using macros and automation tools
  11. Using crawlers, spiders, or similar programs or processing technologies to obtain information from the Service
  12. Modifying, reverse compiling, reverse assembling, reverse engineering, or analyzing the source code
  13. Sending the same or similar content to an unspecified large number of third parties
  14. Placing an excessive load on the Service's system
  15. Altering or deleting information, text, images, or other content on the Service
  16. Impersonating the Company or third parties or intentionally spreading false information
  17. Illegally obtaining, collecting, disclosing, or providing third-party personal information, registration information, usage history information, etc.
  18. Acts that interfere with the operation of the Service, damage the credit, or infringe on the property rights of the Company or third parties
  19. Using the information and services provided on the Service for fraudulent purposes
  20. Acts that negatively affect the physical and mental development of minors
  21. Using the Service by impersonating a third party or using another User's account
  22. The same User registering multiple times
  23. Acts related to fraud, abuse of regulated drugs, illegal buying and selling of bank accounts and mobile phones, etc.
  24. Acts related to criminal proceeds, financing of terrorism, or suspicion thereof
  25. Using the Service under the age of 18
  26. Adult wards, persons under curatorship, or persons under assistance using the Service without the necessary legal representation or prior consent
  27. Using the Service for the purpose of forming relationships with the opposite sex, building romantic relationships, or for sexual purposes
  28. Abusive language, insults, defamation, denial of personality, harassment, threatening behavior (including cases where there is a right but the manner of the claim lacks social appropriateness)
  29. Intentionally exploiting the Service's malfunctions
  30. Repeatedly making similar or identical inquiries to the Company or making unreasonable demands on the Company
  31. Assisting or promoting any of the aforementioned acts
  32. Any other acts that the Company deems inappropriate
  1. The decision as to whether an act falls under the prohibited actions in the preceding paragraph is at the discretion of the Company, and the Company is not obligated to explain its decision criteria.
  2. If the Company determines that a User's action falls under any of the items in paragraph 1, the Company may take any or all of the following measures without prior notice:
  1. Erasure or expulsion of the account
  2. Suspension of eligibility to use the Service
  3. Any other actions deemed necessary by the Company
  4. The Company is not liable for any damage to Users resulting from the measures in the preceding paragraph, except in cases of intentional or gross negligence by the Company.

Article 12 (User Responsibility)

  1. Users shall use the Service at their own responsibility and bear all responsibility for their actions and the results thereof in the Service.
  2. If a User violates these Terms or causes damage to the Company due to intentional or negligent actions in connection with the use of the Service, the User shall compensate the Company for all damages incurred (including lost profits and legal fees).
  3. In the case of the preceding paragraph, the User shall take necessary measures for the restoration of the Company's reputation, etc., at no cost.
  4. If a User fails to fulfill monetary obligations under these Terms of Service, the User shall pay the Company late payment charges at an annual rate of 14.6% (calculated daily based on a 365-day year).
  5. The provisions of the preceding four paragraphs shall remain in effect even after the User's withdrawal or expulsion from the Service.

Article 13 (Intellectual Property Rights)

  1. All intellectual property rights and rights to register such rights (collectively referred to as "Intellectual Property Rights") related to all information and contents provided in the Service (hereinafter collectively referred to as "Service Contents") belong to the Company or licensors licensed by the Company, and not to the Users.
  2. Users do not acquire any rights to the Intellectual Property Rights specified in the preceding paragraph through the use of the Service.
  3. Users may not use, reproduce, modify, translate, republish, publicize, distribute, transfer, license, or otherwise dispose of (hereinafter referred to as "Use, etc.") the Service Contents beyond the scope permitted by copyright law, regardless of method or form.
  4. Users shall transfer all possible copyrights (including the rights specified in Articles 27 and 28 of the Copyright Law) to the Company (or a person designated by the Company, if any. Hereinafter the same in this Article) at no cost, for opinions, inquiries, emails, comments, drawings, images, and other contents and information (hereinafter referred to as "Posted Contents") provided, posted, or submitted by Users on the Service. The Company may, without prior notice, change or delete Posted Contents if it deems that they violate these Terms, if the User withdraws or their account is canceled or erased, or if the Company deems it necessary for the operation of the Service.
  5. Users shall not exercise moral rights of authorship (including the right of disclosure, right of name attribution, and right of integrity) against the Company, any third party who has inherited or been licensed rights from the Company, and those who have inherited rights from such third parties concerning Posted Contents.
  6. The rights and obligations between the Company and Users under this Article shall continue to be valid after the User leaves the Service, deletes their account, or otherwise ceases to use the Service. The Company shall decide on the deletion of Posted Contents not deleted by the User, and the User cannot make any claims or objections to this.

Article 14 (Withdrawal)

  1. Users wishing to withdraw shall apply for withdrawal in the manner prescribed by the Company. Users shall be deemed to have withdrawn from the Service on the last day of the month in which they applied for withdrawal.
  2. Withdrawal is an act performed at the User's own responsibility, and the Company shall not compensate for any damage incurred by the User due to the inability to use the Service during the period of withdrawal.
  3. After withdrawal, the Company acquires all rights related to the User's created account.

Article 15 (Measures Against Violation of Terms)

  1. If a User violates or is likely to violate these Terms or Individual Terms, if objections or claims are made by third parties regarding the use of the Service by the User, or if the Company deems the use of the Service by the User to be inappropriate, the Company may take the following measures without prior notice, as it deems necessary. The Company is not responsible for any consequences resulting from these measures:
  1. Request to stop all or part of the actions that violate or are likely to violate these Terms or Individual Terms
  2. Request to perform actions specified by the Company as appropriate responses to objections or claims from third parties
  3. Request to delete Posted Contents
  4. Deletion or reasonable processing (including making them inaccessible to third parties) of all or part of Posted Contents
  5. Cancellation of the account or suspension of eligibility to use the Service
  6. Any other measures deemed appropriate and reasonable by the Company
  7. Even with the provisions of the preceding paragraph, the Company is not obligated to take the measures specified in the preceding paragraph against any specific User.

Article 16 (Account Cancellation/Expulsion, Suspension of Service Eligibility, etc.)

  1. The Company may, at its discretion and without any notice, cancel or expel an account on the Service or suspend the eligibility to use the Service, if it determines that a User falls under any of the following:
  1. Non-existence of the User
  2. Inability to contact the User member through the contact information provided to the Company
  3. Inclusion of false information in the registration information
  4. Delay or non-performance of payment obligations even once
  5. Previous receipt of account cancellation/expulsion or temporary suspension of service eligibility from the Company
  6. The User being substantially equivalent to a person or entity whose User qualifications have been canceled or restricted
  7. Notification from the User's heirs or other parties regarding the User's death or confirmation of such by the Company
  8. The User or their workplace or other related parties being part of anti-social forces or having inappropriate relations with such forces, or reasonable suspicion thereof
  9. Failure to promptly respond to requests from the Company as stipulated in the previous Article, paragraph 1
  10. Violation of compliance items, prohibited actions, or other provisions of these Terms or being deemed inappropriate as a User
  11. The Company is not liable for any damage incurred by the User due to the measures taken in the preceding paragraph.

Article 17 (Changes, Suspension, etc. of the Service)

  1. The Company may change or add to the name, content, specifications, procedures, details, design, audio-visual effects, expressions, etc. (including but not limited to these) of the Service, in whole or in part, at any time without prior notice to the User.
  2. The Company does not guarantee that all functions and performance of the Service prior to such changes or additions will be maintained.
  3. The Company may suspend or interrupt all or part of the Service in the following cases. In such cases, the Company will endeavor to notify the User in advance as much as possible but does not guarantee prior notice:
  1. In case of force majeure events like fire, power outage, epidemic, natural disaster, etc., making it impossible to operate the Service
  2. When there is a disruption or potential disruption in the facilities, hardware, software, or other environments necessary for the operation of the Service
  3. When regular or emergency maintenance of the computer system related to the Service is conducted
  4. When computers, communication lines, etc. are stopped due to an accident
  5. When requested based on the judgment of laws, judicial bodies, or administrative agencies
  6. Other cases where the Company deems it necessary to stop or interrupt the Service
  7. The Company is not liable for any damage incurred by the User due to the suspension of the Service under the provisions of the preceding paragraph.

Article 18 (Termination of the Service) 

The Company may terminate all or part of the Service at any time.

Article 19 (Handling of Personal Information)

  1. The Company shall handle personal information appropriately in accordance with the separately established Privacy Policy (hereinafter referred to as "Privacy Policy").
  2. If personal information is included in the data entered into the Service, the Company shall not use it for purposes other than those stated in the Privacy Policy and shall take reasonable security measures to protect it from loss, destruction, alteration, leakage, etc., and manage it strictly in accordance with the laws concerning the protection of personal information and the Privacy Policy.
  3. The Company shall promptly dispose of personal information that is no longer necessary for providing the Service under its responsibility.

Article 20 (Disclaimer and Limitation of Liability)

  1. The Company provides a platform for matching Users and Agent Members in the Service. Contracts related to real estate transactions in the Service are established between Users and Agent Members, and the Company is not a party to such contracts. Except as otherwise provided in these Terms, the Company is not involved in the payment, refund, or other execution of real estate sales, rental brokerage, etc., conducted by Users.
  2. The Company does not explicitly or implicitly warrant that the Service and its content are free from factual or legal defects, malfunctions (including defects, errors, or bugs related to completeness, accuracy, safety, timeliness, effectiveness, and suitability for specific purposes, or infringement of rights). The Company is not obligated to remove such defects in the Service.
  3. The Company is not liable for any damage incurred by Users due to refusal, suspension, or termination of the Service, deletion of User accounts, changes in the content of the Service, or any other cause related to or arising from the Service (including direct, indirect, special, consequential, incidental damages, lost profits, loss of business opportunities, data loss or disappearance, etc.). However, this does not apply if the contract between the Company and the User related to the Service (including these Terms) is a consumer contract as defined by the Consumer Contract Act.
  4. Even in the case mentioned in the proviso of the preceding paragraph, the Company is not liable for any special damages arising from specific circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of damage) due to the Company's negligence (excluding gross negligence).
  5. Even when compensating for damages caused to the User due to the Company's negligence (excluding gross negligence), the amount of compensation for such damages shall be limited to the higher of the total amount paid by the User to the Company for the Service that caused the damage in the past year (zero yen if the total amount is zero yen) or 30,000 yen.
  6. In case of disputes arising between Users or between Users and third parties related to the use or inability to use the Service, the Company shall not be involved or liable in any way, and such disputes shall be resolved at the expense and responsibility of the relevant User.
  7. If the User's counterpart, being another User or a third party, makes any claim or initiates a lawsuit against the Company, the User shall cooperate in all respects with the Company's response to the third party and compensate the Company for all damages incurred in connection with the claim or lawsuit.
  8. Users shall use the Service only within the scope of the laws of Japan and their own nationality country, and the Company shall not be liable or responsible if the User violates the laws of Japan or the User's nationality country in connection with the use of the Service.
  9. The Company shall not be liable for any non-performance of all or part of this contract due to force majeure such as natural disasters, changes in the earth, fire, strikes, trade stoppages, wars, civil unrest, epidemics, or other uncontrollable events.
  10. The provisions of the preceding paragraphs shall remain in effect even after the User's withdrawal or expulsion from the Service.

Article 21 (Exclusion of Anti-Social Forces)

  1. Users represent and warrant that they currently do not fall under anti-social forces such as organized crime groups, gang members, those who have not passed five years since leaving gang membership, semi-gang members, companies related to organized crime groups, corporate extortionists, etc., social movement racketeers, groups with special intelligence violence, or others equivalent to these (hereinafter referred to as "Gang Members, etc."), and will not fall under any of these in the future. Users also assure that they will not fall under any of the following:
  1. Having a relationship recognized as being controlled in management by Gang Members, etc.
  2. Having a relationship recognized as substantially involved in the management by Gang Members, etc.
  3. Using Gang Members, etc. for the purpose of seeking illegitimate benefits for oneself, one's company, or third parties, or causing damage to third parties
  4. Providing funds or conveniences to Gang Members, etc. or being involved in such activities
  5. Having socially reprehensible relationships with Gang Members, etc., where officers or persons substantially involved in management are involved
  6. Users promise not to engage in any of the following acts either by themselves or through the use of third parties:
  1. Violent demanding behavior
  2. Unreasonable demanding behavior beyond legal responsibility
  3. Threatening behavior or using violence in transactions
  4. Spreading rumors, using fraud or force to damage the reputation or obstruct the business of another party
  5. Other acts similar to the aforementioned
  1. If a User falls under any of the items in paragraph 1 or engages in any of the acts in paragraph 2, the Company may, without any notice, take measures such as cancellation of membership qualifications, termination of the contract, or other measures deemed necessary by the Company.
  2. Even if the Company refuses to provide the Service or cancels the membership qualification of the User under the preceding paragraph, the Company shall not compensate for any damage incurred by the User.

Article 22 (Contact and Notification)

  1. Inquiries related to the Service and other communications or notifications from Users to the Company shall be made through the [Contact Us (For Users)] section on the website.
  2. When the Company makes a notification to Users regarding the Service, it will do so by posting the content of the notification on the Service or the Company's website, or by any other method deemed appropriate by the Company.
  3. Notifications in the preceding paragraph will take effect from the time the Company posts them on the Service or the Company's website.
  4. When the Company makes individual notifications to Users, it shall be deemed to have notified them by contacting the email address, address, or telephone number registered by the User in the Service. Notifications from the Company take effect at the time of dispatch.

Article 23 (Transfer of Status, etc.)

  1. Except as otherwise provided in these Terms, Users may not transfer, move, set as collateral, or otherwise dispose of their status under this contract or any rights or obligations based on these Terms to third parties without the prior written consent of the Company. However, this does not apply to business transfers, mergers, company splits, or other organizational restructurings.
  2. The Company may transfer its receivables from Users to third parties, and Users consent to the provision of their registration information to such third parties for this purpose.

Article 24 (Outsourcing) 

The Company may outsource all or part of the tasks related to the provision of the Service to third parties without the consent of Users. In such cases, the Company will responsibly manage the outsourced party.

Article 25 (Severability)

  1. Even if any provision or part of these Terms is found to be invalid or unenforceable, such determination shall not affect the other parts of these Terms, which shall continue to be valid and enforceable. The Company and Users agree to endeavor to ensure the equivalent effect of the invalid or unenforceable provision or part in accordance with its intent and be bound by the amended Terms.
  2. Even if any provision or part of these Terms is found to be invalid or unenforceable with respect to a certain User, it shall not affect the validity of these Terms with respect to other Users.

Article 26 (Governing Law and Agreed Jurisdiction) 

The governing law of these Terms shall be Japanese law, and any and all disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

Article 27 (Others) 

These Terms are written in Japanese. Versions in other languages are provided for reference only and are not official texts. In case of any contradiction or discrepancy between the Japanese version and versions in other languages, the content of the Japanese version shall prevail. The contents stipulated in versions in other languages shall not supplement or amend the content of the Japanese version.

Article 28 (Consultation and Resolution) 

The Company and Users agree that if there is any matter not stipulated in these Terms or if there is any doubt regarding the interpretation of these Terms, they shall resolve it promptly through consultations in accordance with the principles of good faith and trustworthiness.

Privacy Policy and Personal Information Protection Policy

This Privacy Policy (hereinafter referred to as "this Policy") sets forth the handling of personal information acquired by JP Consulting Inc. (hereinafter referred to as "the Company") in connection with the internet site Platform (hereinafter referred to as "the Service") operated by the Company. The Company collects personal information related to users of the Service (hereinafter referred to as "Users") or those who post property information on the Service (hereinafter referred to as "Agent Members") within the necessary scope for operating the Service and providing the Company's services. In this Policy, Users and Agent Members may collectively be referred to as "Customers".

The Company and all its officers and employees recognize the protection of personal information entrusted to us by Customers in the operation of the Service as an important social mission. All officers and employees will comply with laws, guidelines, and other norms related to the protection of personal information. In addition to this Policy, if Customers have given separate consent (hereinafter referred to as "Individual Consent"), the contents of such Individual Consent shall prevail.

1.Personal Information

 "Personal Information" refers to information about a living individual as defined in the Act on the Protection of Personal Information (Act No. 57 of 2003, hereinafter referred to as the "Personal Information Protection Act"), which can identify the specific individual by name, date of birth, or other descriptions contained in the information, or includes a personal identification code.

2.Commonly Acquired Information

The personal information acquired by the Company in providing the Service includes, but is not limited to, the following items. The items listed below are illustrative examples:

•Name, gender, age, nationality, residence, phone number, email address, and other contact information, language used, etc.

•Desired property conditions (region, type, layout, size, age of the building, budget, and other preferences)

•Service browsing history (web pages viewed, dates, frequency, etc.), search history, and other behavioral history (Includes comments and messages entered and sent by Customers for communication with others using tools available on the Service, such as chatbots.)

<Main Information Acquired from Agent Members>

Real estate license number, name or company name, representative's name, location, phone number, person in charge, email address, etc.

<Commonly Acquired Information>

• Login ID, password, and other information

•Information related to inquiries, contacts, etc., made to the Company by the Customer

•Service usage history, transaction content and history initiated through the Service, negotiation and conclusion status, etc.

•Information related to the Customer's internet usage (information collected by cookies by the Company or provided by third parties, including website, search keywords, history of advertisement views and clicks, access logs, IP addresses, browser information viewing time, viewing method (type of browser), the usage environment of the device used during viewing (connection environment, carrier information), cookie information, IP address, device unique identification number, and other information mechanically acquired upon accessing the Company's server)

•Call records (including recordings and video recordings, if any) and message information

•Other information registered, entered, or provided by the Customer when using the Service

3.Acquisition and Use of Personal Information

The Company will acquire and use personal information of individuals within the necessary scope for the following purposes. The Company will obtain prior consent in an appropriate manner from the individual if it uses personal information beyond the scope of the following purposes:

1)To provide the Service

2)For account registration and identity verification of Customers

3)To respond to inquiries, opinions, and other communications from Customers (including identity verification)

4)For necessary contact from the Company to Customers, such as for maintenance and important announcements

5)To provide Users' information (including information entered by Users at the time of account registration and application for materials, viewing appointments, etc.) to real estate agents (including members who post properties on the Service) based on requests for materials or viewing appointments made by Users

6)To provide personal information (including account information, name, contact information, nationality, language used, and other identifiers to identify the User) to the extent necessary to provide interpretation and translation services by companies affiliated with the Company, based on Users' applications for viewings and meetings

7)To investigate and analyze the usage history of the Service, etc., and use the results for improvement and enhancement of the Service or the Company's services or for planning, research, and development of new services

8)For the introduction of new features, updates, campaigns, etc., of the Service and other services provided by the Company (including sending emails, flyers, and other direct mails)

9)To request cooperation in surveys, interviews, etc., related to the Service, invite participation in various events, or report the results

10)To provide browsing information and cookie-based information obtained through the Service to advertisers, think tanks, real estate agents, and other third parties for marketing and advertising activities by the Company or real estate agents, etc. (※ The Company may analyze Customers' interests, preferences, purchasing trends, attributes, etc., based on browsing information and cookie-based information obtained through the Service, and utilize the results for information provision and advertising activities)

11)To use or provide information on the usage of the Service, such as statistical information or information processed into a format that does not and cannot identify individuals, to advertisers, research institutions, think tanks, real estate agents, and other third parties

12)For the prevention, detection, warning, and other responses to violations of the Service Terms, fraudulent activities, and other misconduct

13)For other purposes, to appropriately and smoothly execute transactions between the Company/the Company's group companies and Users or Agent Members, and contacts with affiliated business partners

4. Provision to Third Parties

The Company will not provide personal information to third parties without obtaining the individual's consent, except in the following cases:

1)When it is necessary to protect the life, body, or property of an individual and it is difficult to obtain the individual's consent.

2)When it is particularly necessary for improving public health or promoting the sound growth of children, and it is difficult to obtain the individual's consent.

3)When it is necessary to cooperate with a national institution, local public entity, or a person entrusted by them in executing affairs prescribed by laws, and obtaining the individual's consent is likely to impede the execution of such affairs.

4)When all or part of the handling of personal information is entrusted to ensure smooth execution of business, within the scope necessary for the achievement of the purpose of use.

5)When personal information is provided in connection with business succession due to merger or other reasons.

6)When personal information is jointly used with specific parties, and the Company has notified the individual in advance or put the individual in a readily ascertainable position regarding the fact of joint use, the items of personal information to be jointly used, the scope of joint users, the purpose of use by the users, and the name or title of the person responsible for the management of the personal information.

7)In other cases permitted by law.

5. Safety Management

The Company shall take necessary measures for preventing and correcting risks such as unauthorized access to personal information, loss, destruction, damage, alteration, and leakage of personal information, and other safety management of personal information.

6. Change of Purpose of Use of Personal Information

The Company will not change the purpose of use of personal information specified in the preceding paragraph, except with the consent of the individual, in principle. However, if the change of purpose of use is within a reasonably recognized range that has substantial relevance to the purpose of use before the change, the Company may change it after publishing the purpose of use after the change.

7. Outsourcing of Personal Information Handling

The Company may outsource all or part of the handling of personal information to third parties. In such cases, the Company will thoroughly assess the eligibility of the outsourced party and stipulate matters related to confidentiality obligations in the contract, while conducting necessary and appropriate supervision over the outsourced party. The Company may jointly use the acquired personal information with others in accordance with the provisions of the Personal Information Protection Law.

8. Anonymous Processed Information

The Company may create and provide to third parties information obtained by processing Customers' personal information in such a way that specific individuals cannot be identified and the original personal information cannot be restored (hereinafter referred to as "Anonymous Processed Information"). When handling Anonymous Processed Information, the Company will not perform any actions to identify individuals related to the personal information used to create the Anonymous Processed Information, nor will it match the Anonymous Processed Information with other information. When the Company creates Anonymous Processed Information, it will promptly publish the items of information included in the created Anonymous Processed Information after its creation. When providing Anonymous Processed Information to third parties, the Company will publish the items of personal information included in the Anonymous Processed Information to be provided and the method of provision, and explicitly indicate to the third parties that the information provided is Anonymous Processed Information. The Company will not perform any actions to identify individuals related to the personal information used to create the Anonymous Processed Information, nor will it match the Anonymous Processed Information with other information.

9. Improvement and Review of Personal Information Handling

The Company will conduct inspections regarding the handling, management system, and initiatives of personal information and will continuously improve and review these practices.

10. Disclosure of Personal Information

The Company will disclose personal information to the individual upon request, in accordance with the Company's prescribed procedures (note that certain identity verification procedures and the burden of fees may be required). The disclosure will be made promptly after verifying the individual's identity. However, in the following cases, the Company may not disclose all or part of the information, and if a decision is made not to disclose, the Company will notify the individual of this decision:

1)If there is a risk of harm to the life, body, property, or other rights and interests of the individual or a third party.

2)If there is a risk of significantly hindering the proper execution of the Company's business.

3)If it would result in a violation of other laws.

11. Correction and Deletion of Personal Information

If the personal information held by the Company is incorrect, the Company will correct or delete the information in accordance with the prescribed procedures upon the individual's request (note that certain identity verification procedures and the burden of fees may be required). The Company will erase or dispose of personal information when it is no longer necessary in relation to the purpose of use, taking necessary and appropriate measures to prevent risks such as external leakage during the process. The Company determines the retention period of personal information based on criteria such as the necessity for achieving the purpose of use set out in this Policy, the length of the ongoing relationship with the User, the presence or absence of legal obligations, and whether the User is required to fulfill a contract as a party.

12. Procedures for Disclosure, Correction, Suspension of Use, etc., of Personal Data

Users can request notification of the purpose of use, disclosure of personal data or third-party provision records, correction, addition, deletion of content of personal data, and suspension of use, erasure, or suspension of provision to third parties of personal data, in accordance with the Company's prescribed procedures. Note that certain identity verification procedures and the burden of fees may be required.

13. Suspension of Use of Personal Information

If the Company is requested by the individual to suspend or erase the use of personal information (hereinafter referred to as "Suspension, etc.") on the grounds that the information is being handled beyond the scope of the purpose of use or was acquired by improper means, the Company will conduct necessary investigations. Based on the results, if deemed necessary, the Company will carry out the Suspension, etc. of personal information and notify the individual. However, if Suspension, etc. involves a significant cost or is difficult to implement, and if alternative measures can be taken to protect the individual's rights and interests, such alternative measures will be taken.

14. About Cookies

The Company may use cookies to protect the privacy of Customers, improve the convenience of the Service and the Company's services, deliver advertisements, and acquire statistical information. Cookies are text files sent from a web server to a web browser and stored on the internal storage of the Customer's device when accessing a website. When using certain web services, the web server refers to cookies to automatically identify the Customer's device, allowing convenient use of the website without the need to repeatedly enter the same information. Customers can display on their web browser that they are on a website using cookies and can disable or delete cookies.

15. International Transfer of Personal Information

The purpose of the Service is to enable people worldwide to access real estate transactions located in Japan, and the Service is available globally. Therefore, Customers' personal information may be accessed by third parties located outside of Japan, including the counterparties of real estate transactions, third parties who mediate, support, or are involved in real estate transactions (including providers of interpretation services and payment services) through the Service. These jurisdictions may have laws different from the data protection laws of the country or region where the Customer resides, and in some cases, may not be as comprehensive or offer sufficient protection. The Company endeavors to take appropriate measures to ensure that Customers' personal information is handled as described in this Policy and in accordance with applicable data protection laws.

゚ヌゞェント䌚員利甚芏玄

第 1 条目的・適甚

1.この利甚芏玄以䞋「本芏玄」ずいいたす。は、株匏䌚瀟JPコンサルティング以䞋「圓瀟」ずいいたす。が運営する「Platform」以䞋「本サヌビス」ずいいたす。に䌚員登録をし、自らが売買、賃貞若しくは亀換又はそれらの媒介、仲介若しくは代理以䞋、これらを総称しお「売買等」ずいいたす。を行う䞍動産の物件情報の掲茉をする方法により本サヌビスを利甚する方゚ヌゞェント䌚員をいい、以䞋「䌚員」ずいいたす。) 及び䌚員になろうずする方埌述する仮登録申蟌者を含みたす。以䞋、総称しお「䌚員等」ずいいたす。に察し、本サヌビスの利甚に関わる䞀切の関係に適甚されたす。

2.本芏玄は、本サヌビスの利甚条件を定めおいたす。䌚員等は、本芏玄に同意の䞊、党お本芏玄に埓い、本芏玄の定める条件に埓っおのみ本サヌビスを利甚できるものずしたす。

3.䌚員等が本芏玄に同意するこずにより、圓瀟ずの間に本契玄本芏玄を契玄条件ずしお圓瀟ず䌚員等ずの間に締結される本サヌビスの提䟛に関する契玄を蚀いたす。が成立したす。

4.圓瀟は、本サヌビスの党郚又は䞀郚に適甚される遵守事項以䞋「個別芏玄」ずいいたすを別途定めるこずがありたす。別段の定めがない限り、個別芏玄は本芏玄の䞀郚を構成するものずしたす。 本芏玄の内容ず個別芏玄の内容に霟霬がある堎合は、個別芏玄が本芏玄に優先しお適甚されるものずしたす。

第 2 条本芏玄の倉曎

1.圓瀟は、以䞋の各号のいずれかに該圓する堎合は、本芏玄及び個別芏玄を随時倉曎できるものずしたす。

(1)名称又は圢匏的衚珟の倉曎、誀字の修正その他本芏玄及び個別芏玄の実質的内容に倉曎が生じないずき

(2)本芏玄の倉曎が、䌚員等の䞀般の利益に適合するずき

(3)本芏玄の倉曎が、契玄をした目的に反せず、か぀、倉曎の必芁性、倉曎埌の内容の盞圓性及びその内容その他の倉曎に係る事情に照らしお合理的なものであるずき

2.倉曎埌の本芏玄及び個別芏玄は、本サヌビスぞの掲茉その他圓瀟が適切ず刀断した適宜の方法により呚知された時点からその効力を生じるものずし、䌚員等は、本芏玄及び個別芏玄の倉曎埌も本サヌビスを利甚した堎合又は盞圓の期間圓瀟所定の期間がある堎合は圓該期間内に解玄の手続を取らなかった堎合、倉曎埌の本芏玄及び個別芏玄に察する有効か぀取消䞍胜な同意をしたものずみなされたす。

3.本サヌビスをご利甚の際には、随時、最新の本芏玄及び適甚のある個別芏玄をご参照䞋さい。

4.圓瀟は、本芏玄の倉曎により䌚員等が被った損害に぀き䞀切の責任を負わないものずしたす。

第 3 条本サヌビスの利甚条件

本サヌビスの䌚員ずしお登録されるためには、以䞋の条件をいずれも満たす必芁がありたす。

(1)宅地建物取匕業免蚱を有しおいるこず

(2)申蟌前ヶ月以内に宅地建物取匕業法䞊の業務停止凊分その他の法什に基づく行政凊分を受けおいないこず

(3)申蟌前ヶ月以内に宅地建物取匕業法に基づく聎聞の公瀺がなされおいないこず

(4)本芏玄の内容に同意の䞊、圓瀟が定める方法により䌚員登録をするこず

第 4 条䌚員登録

1.本サヌビスの䌚員になろうずする方は、圓瀟が定める方法により䌚員資栌の仮登録の申し蟌みをするものずしたす以䞋、仮登録の申蟌みをした方を「仮登録申蟌者」ずいいたす。。

2.圓瀟は、仮登録申蟌者に察し所定の審査を行った䞊で、仮登録申蟌者に察し、䌚員登録の承認をするか吊かを、申蟌時に登録されたメヌルアドレスにメヌルを送信する方法により通知したす。

3.圓瀟が䌚員登録の承認をした仮登録申蟌者が、本サヌビスの䌚員ずなりたす。

4.仮登録の際に登録された情報は、䌚員登録埌も、そのたた圓該䌚員情報以䞋、「アカりント情報」ずいいたす。ずしお登録されたす。

5.圓瀟は、仮登録申蟌者が次の各号のいずれかに該圓する堎合、䌚員登録の承認をしないこずがありたす。

(1)登録された情報が虚停又は䞍正確であるずき

(2)過去に本芏玄の違反又はこれに準じる事由により、本サヌビスの利甚停止、䌚員登録の取消し等の凊分を受けおいるずき

(3)仮登録申蟌者が反瀟䌚的勢力に該圓する又はこれず関係性を有するず圓瀟が合理的に刀断するずき

(4)その他、前号各号に準じる事由があるほか、䌚員登録が適圓でないず圓瀟においお合理的に刀断する堎合

6.本サヌビスのアカりント情報及び䌚員等の地䜍は、第䞉者に察しお䜿甚蚱諟、貞䞎、譲枡、売買又は担保䟛䞎等をするこずが䞀切できないものずしたす。

第 5 条ID及びパスワヌドの管理

1.䌚員等は、圓瀟が䌚員等に付䞎するID及びパスワヌド以䞋、「ログむン情報」ずいいたす。の管理責任を負いたす。䌚員等は、自己のログむン情報を厳重に管理・保管し、これを第䞉者に察しお䜿甚蚱諟、貞䞎、譲枡、売買又は担保䟛䞎等をするこずはできないものずいたしたす。　　

2.䌚員等は、ログむン情報の管理䞍十分、䜿甚䞊の過誀、第䞉者の䜿甚等による損害の責任を負うものずし、圓瀟に故意又は重過倱がある堎合を陀き、圓瀟は䞀切責任を負わないものずしたす。

3.䌚員等は、定期的にパスワヌドを倉曎する矩務があるものずし、その矩務を怠ったこずにより圓該䌚員等たたは第䞉者に発生した損害に関しお、圓瀟は䞀切責任を負わないものずしたす。

4.䌚員等のログむン情報を利甚しお行われた行為は、圓該IDを保有しおいる䌚員等の行為ずみなされ、圓該行為から䌚員等たたは第䞉者に損害が生じたずしおも、その責任は党お圓該䌚員等に存し、圓瀟は䞀切責任を負わないものずしたす。

5.䌚員等は、ログむン情報が挏えいした堎合、ログむン情報の玛倱・倱念があった堎合、ログむン情報が第䞉者により䞍正に利甚されおいるこずが刀明した堎合又はれらのおそれがある堎合、盎ちに圓瀟に連絡するものずしたす。この堎合、圓瀟から指瀺があったずきは、䌚員等はこれに異議なく埓うものずしたす。

6.ログむン情報の盗難、玛倱等があったこずに起因しお䌚員等ナヌザヌに損害が発生したずしおも、圓瀟は䞀切責任を負わないものずしたす。

7.予期しない䞍正アクセス等の行為によっおログむン情報を盗取された堎合でも、それによっお生じる䌚員等の損害に察しお、圓瀟は䞀切の責任を負わないものずしたす。

第 6 条アカりント情報の正確性

1.䌚員等は、圓瀟に察し、その登録するアカりント情報が、その時その時の情報を正確に衚したものであり、誀りが含たれおいないこずを保蚌するものずしたす。

2.䌚員等は、次の各号に掲げる事項に倉曎が生じた堎合は、速やかに、本サヌビス䞊のアカりント情報を曎新するものずしたす。䌚員等がアカりント情報の倉曎を行わなかったこずにより損害を被った堎合でも、圓瀟は䞀切の責任を負わないものずしたす。

(1)氏名若しくは名称

(2)代衚者の氏名

(3)宅地建物取匕業の免蚱番号

(4)䜏所又は営業所の所圚地、電話番号、ファクシミリ番号、電子メヌルアドレス等

第 7 条サヌビス利甚料金等

1.䌚員は、本サヌビスにおいお定める利甚料金を、本サヌビスにおいお定める支払方法及び支払期日で支払うものずしたす。なお、銀行振蟌手数料その他支払に芁する費甚は、䌚員の負担ずしたす。

2.サヌビスの利甚開始日又は終了日が月の途䞭の堎合であっおも、䌚員は、圓該開始日又は終了日が属する月分の党額の利甚料金を圓瀟に支払うものずし、圓瀟は日割蚈算を行わないものずしたす。

3.䌚員等が本サヌビスの利甚料金又は本芏玄の䞍履行により圓瀟に察しお負う損害賠償金の支払を遅延した堎合、幎14.6の割合1幎を365日ずする日割蚈算による遅延損害金を圓瀟に支払うものずしたす。

4.本サヌビス内容の倉曎、法什・ガむドラむン等の制定改廃、コストの増加その他の経枈情勢の倉動、その他圓瀟の事業䞊の理由等によっお、本サヌビスの利甚料金の倉曎又は新蚭の必芁が生じたずきは、圓瀟は、利甚料金を任意に倉曎等するこずができるものずしたす。

5.圓瀟の故意又は重過倱に起因する堎合を陀き、事由の劂䜕を問わず、圓瀟が䌚員等に察しお返金をする堎合の手数料は䌚員の負担ずしたす。

第 8 条債暩譲枡

1.圓瀟は、䌚員が圓瀟に察しお負う本サヌビスの利甚料金本芏玄に定める物件掲茉料を含みたす。その他の債務に係る債暩を、その発生の郜床、決枈事業者に譲枡したす。ただし、決枈事業者から債暩の譲受けを拒たれた堎合を陀きたす。

2.決枈事業者が前項の債暩の譲受けを拒んだ堎合でも、圓瀟は、別に定める堎合を陀き、本サヌビスの利甚料金の請求業務を決枈事業者に委蚗したす。

3.䌚員は、圓瀟が決枈事業者に察し、本サヌビスの利甚料金その他の債務に係る債暩を譲枡するこずを承諟するものずしたす。圓瀟は、䌚員等に察し個々に発生する債暩を譲枡する際、郜床の通知を省略するこずがありたす。

4.圓瀟が債暩を譲枡するこずずなる利甚料金その他の債務に関するその他の取り扱いに぀いおは、本芏玄に別段の定めがある堎合を陀き、決枈事業者の芏玄等に定めるずころによるものずしたす。

第 9 条物件掲茉枠

1.䌚員が本サヌビスにおいお物件掲茉枠本サヌビスの怜玢結果に物件情報を掲茉するこずができる単䜍をいいたす。以䞋においお同じ。を利甚するためには、圓瀟の定めに埓いその利甚を申し蟌み、か぀、物件掲茉枠の利甚料金以䞋「物件掲茉料」ずいいたす。の支払いを完了するこずが必芁です。なお、支払いに係る手数料は䌚員の負担ずしたす。

2.圓瀟は、䌚員等から物件掲茉枠の利甚申蟌みがあったずきは、特段の事情䌚員登録の䞍承認を含みたすが、これに限られたせん。がある堎合を陀き、圓該䌚員等に察し、盞圓な期間を定め、物件掲茉料をご請求したす。なお、このご請求は、原則ずしお圓瀟が提携する代金決枈事業者が行いたす。

3.䌚員が前項の期間内に物件掲茉料を支払わなかったずきは、圓瀟の刀断により物件掲茉枠を利甚できないこずがあり、䌚員はこれに察し䞀切の異議を述べられないものずしたす。前項の盞圓な期間は、圓瀟又は決枈事業者の事情により、盞圓の範囲内で倉曎されるこずがありたす。

4.圓瀟は、圓瀟がその必芁を認めた堎合は、䌚員による物件掲茉枠の利甚申蟌みを取り消すこずができるものずしたす。この堎合、圓瀟は所定の手続きにより必芁な返金凊理を行うものずしたす。なお、返金に芁する費甚は䌚員の負担ずしたす。

5. 圓瀟は、圓瀟がその必芁を認めた堎合本サヌビス利甚料金の収玍代行及び保蚌を決枈事業者に委蚗する際に、圓該決枈事業者が圓該䌚員等の䞎信審査を行った結果、䞎信が承認されなかった堎合を含みたすが、これに限られたせん。は、圓該䌚員等のアカりントの利甚停止ができるものずしたす。この堎合の取扱いに぀いおは、前項䞭段及び埌段の芏定を準甚したす。

第 10 条物件掲茉料、支払条件等

1.䌚員は、利甚を申し蟌んだ物件掲茉枠に応じお、所定の物件掲茉料を圓瀟に察しお支払う債務を負うものずしたす。物件掲茉料の金額は、本サヌビスにおいお定めるずおりずいたしたす。

2.䌚員は、前項の金員に関し、本サヌビスにおいお別に定める堎合を陀き、翌月分を毎月末日たでに支払うものずしたす。

3.物件掲茉料の算定にあたり、日割蚈算はしないものずしたす。すなわち、䌚員等資栌の付䞎又は退䌚、䌚員等資栌の取消若しくは解玄のあった日が月の途䞭であっおも、日割蚈算はされず、䌚員等は䞀月分の物件掲茉料の満額を支払う矩務を負いたす。

4.圓瀟は、物件掲茉料に関する事項を予告なく随時倉曎するこずがあり、䌚員等は圓該条件の倉曎を理由に異議を述べるこずができず、たた、既に泚文した物件掲茉枠の利甚契玄の取消や返金を求めるこずはできないものずいたしたす。

第 11 条物件掲茉枠のキャンセル

　物件掲茉枠の申蟌み完了埌は、䌚員等がその郜合により物件掲茉枠利甚契玄の取消し、撀回、即時解玄をするこずは䞀切認められたせん。

第 12 条物件掲茉枠ぞの情報掲茉

1.本サヌビスに掲茉できる物件情報は、䌚員が民法その他の法什に照らし自ら売华、賃貞若しくは亀換をするこずができる物件、又は売䞻、貞䞻等を代理若しくは媒介するこずができる物件に関するものに限られたす。

2.䌚員共通の利益に資する堎合は、前項に芏定する芁件を充たさない情報であっおも、圓瀟の刀断により登録及び公開を認めるこずがありたす。

3.次の各号のいずれかに該圓するず圓瀟が刀断した物件情報は、本サヌビスに掲茉できたせん。

(1)架空の物件に関するもの

(2)成玄枈みの物件に関するもの

(3)売华若しくは賃貞する意思がない物件に関するもの

(4)暩利関係に関し係争裁刀倖における玛争を含む。䞭の物件に関するもの 

(5)通垞の甚法に必芁な最䜎限の蚭備を欠く物件に関するもの

(6)郜垂蚈画法、建築基準法その他の法什に適合しない問題が存する物件に関するもの

(7)反瀟䌚的勢力又は反瀟䌚的勢力ず本芏玄で定める関係性を有する者が所有するなど、反瀟䌚的勢力ず係わりがある物件に関するもの

(8)広告衚瀺、䟡栌衚瀺又は取匕圢態が䞍圓又は䞍適切であるもの 

(9)前各号に定めるもののほか、掲茉が適切・盞圓でないもの

4.圓瀟は、前項各号に該圓する可胜性があるず刀断した物件情報を掲茉する䌚員に察し照䌚をするこずができるものずし、䌚員が圓該照䌚に関し、圓瀟が提䟛を求めた情報・資料を十分に提出しない堎合、圓瀟は、圓該物件情報を掲茉䞍可胜な情報ずみなすこずができたす。 

5.䌚員は、本芏玄又は圓瀟の定めにより物件掲茉枠に掲茉䞍可胜な物件情報があった堎合でも、䞀切の異議を述べるこずはできず、䌚員は、圓該掲茉䞍可胜な物件情報に぀いお既に支払った掲茉料の返還を求めるこずはできたせん。ただし、刀断の誀りに圓瀟の故意又は重倧な過倱があった堎合はこの限りではありたせん。

6.圓瀟は、䌚員が物件掲茉枠に掲茉した情報が、以䞋の事項に該圓するず刀断した堎合、䌚員に通知するこずなく、圓該情報たたは文章等を削陀するこずができるものずしたす。なお、圓瀟又は圓瀟が指定した者は、圓該情報の削陀矩務を負うものではありたせん。

1)登録、提䟛された情報又は文章等の容量が圓瀟の機噚の所定の蚘録容量又は文曞数を超過した堎合

2)本芏玄の犁止事項に該圓しその他本芏玄に抵觊する堎合 

3)その他、圓瀟が削陀の必芁があるず刀断した堎合

7.圓瀟もしくは圓瀟が指定した者は、本条の芏定に埓い情報を削陀したこず、たたは情報を削陀しなかったこずにより䌚員もしくは第䞉者に発生した損害に぀いお、䞀切責任を負いたせん。

第 13 条翻蚳ツヌル

1.本サヌビスにおいおは、䌚員が物件掲茉枠ぞ物件情報の掲茉する際及び第䞉者ずコミュニケヌションをする際に利甚するAIツヌル、翻蚳ツヌル「販促チラシ䜜成サヌビス」を含みたすが、これに限られたせん。以䞋総称しお「翻蚳ツヌル」ずいいたす。を有償又は無償にお利甚するこずができたす。

2.前項の翻蚳ツヌルは、本芏玄に基づき物件掲茉枠の利甚をするこずができる䌚員のみが利甚するこずができ、それ以倖の䌚員はこれを利甚するこずができたせん。

3.圓瀟は、翻蚳ツヌルの正確性を䞀切保蚌いたしたせん。䌚員は、翻蚳ツヌルに誀蚳がありうるこずを十分に認識・理解をしお慎重に行動するものずしたす。

4.翻蚳ツヌルに誀蚳があったこずにより、䌚員、取匕の盞手方その他の第䞉者が誀解に基づく行動に出たこずにより、䌚員が損倱、䞍利益を受けたずしおも、圓瀟は䞀切の責任を負いたせん。

第 14 条ご利甚環境の敎備・維持

1.䌚員は、本サヌビスを利甚するにあたり必芁ずなる通信機噚、オぺヌレヌションシステム、通信手段、以䞋のもの名称、URL は本芏玄制定時の情報であり、郜床倉曎されるこずがありたす。を含むツヌル・アプリケヌション及び電力その他の利甚環境・蚭備を、自身の費甚ず責任においお甚意するものずしたす。圓瀟は、䌚員等が圓該環境を敎えるこずに関し、有償無償を問わず、事実䞊のものも含め協力をする矩務及び責任を䞀切負いたせん。

2.䌚員は、本サヌビスを利甚するにあたり自己の責任ず費甚をもっお、電気通信事業者等の電気通信サヌビスを利甚しお䌚員の蚭備をむンタヌネットに接続するものずしたす。

3.前項に挙げる䌚員の蚭備、ツヌル、アプリ、むンタヌネット環境その他の本サヌビス利甚のための環境・蚭備に䞍具合がある堎合であっおも、圓瀟は䌚員に察し、有償無償を問わず、本サヌビスの利甚に関しサポヌトをする矩務その他䞀切の矩務ないし責任を負わないものずしたす。

第 15 条圓瀟提携事業者による通蚳等サヌビス

1.䌚員は、本サヌビスを利甚するにあたり、圓瀟が提携する事業者以䞋、「蚀語サポヌトセンタヌ」ずいいたす。による通蚳人掟遣サヌビス又は翻蚳サヌビス以䞋、「通蚳等サヌビス」ずいいたす。を利甚するこずができたす。

2.䌚員が前項のサヌビスを利甚するためには、圓該サヌビスの利甚を申し蟌むこずが必芁であり、蚀語サポヌトセンタヌがこれに承諟し、䞡者の間で通蚳等サヌビスに関する業務委蚗契玄を締結するこずが必芁です。

3.圓瀟は、蚀語サポヌトセンタヌず䌚員ずの間の契玄締結を保蚌するものではありたせん。圓瀟は、理由の劂䜕を問わず、䌚員が蚀語サポヌトセンタヌから契玄締結を拒吊された堎合であっおも、䞀切の責任を負いたせん。

4.通蚳等サヌビスに関する契玄は、䌚員及び蚀語サポヌトセンタヌの二者間の契玄であっお、圓瀟はこれに関䞎するものずではありたせん。通蚳等サヌビスの利甚にあたっお䌚員ず蚀語サポヌトセンタヌの間でトラブルその他の問題が発生した堎合であっおも、圓該二者間の責任においお解決するものずし、圓瀟はその責任を負いたせん。

5.蚀語サポヌトセンタヌの過倱により通蚳等サヌビスに関し䜕らかの䞍履行があったずしおも、圓瀟は䞀切の責任を負いたせん。

第 16 条遵守事項

1.䌚員は、本サヌビスを利甚するにあたり、宅地建物取匕業法、景品衚瀺法その他の法什、条䟋、ガむドラむンその他の諞芏範を遵守するものずしたす

2.䌚員が本サヌビスの利甚により物件情報を公開する堎合、前項に芏定する芏範のほか、䞍動産の衚瀺に関する公正競争芏玄その他の関係諞団䜓の定める芏範を遵守するものずしたす。

3.䌚員は、本サヌビスの利甚によっお個人情報等を取埗し、又は保有する堎合、個人情報の保護に関する法什、芏則、個人情報保護委員䌚のガむドラむンその他の諞芏範を遵守するものずしたす。

4.䌚員の䞍圓又は䞍適切な行為に察し、圓瀟が圓該行為の停止、圓該行為に関する情報提䟛又は改善等を芁請したずきは、䌚員はこの芁請に埓うものずしたす。

5.䌚員は、自ら又は第䞉者をしお、圓瀟が営む情報流通事業ず競合する業務を行わず、たた、本サヌビスの利甚により入手した情報を、本サヌビスが予定しおいる利甚態様を超えお利甚耇補、送信、転茉、改倉等の行為を含みたす。しおはならず、第䞉者に提䟛しおはならないものずしたす。

6.䌚員は、消費者や他の䌚員又は圓瀟からの問合せに察しお迅速か぀誠実に察応するものずしたす。

7.䌚員は、本サヌビス䞊で公開された情報を、䌚員自らが営む宅地建物取匕業の以倖の取匕のために利甚しおはならないものずしたす。

8.䌚員は、本サヌビスの利甚により知り埗た他人の秘密を、正圓な理由なくしお他に開瀺しおはならないものずしたす。

第 17 条機密保持

1.䌚員は、圓瀟を含む他者から、曞面、電磁的デヌタ、口頭その他の圢匏の劂䜕を問わず、又は秘密の衚瀺若しくは明瀺又はその範囲の特定の有無にかかわらず本サヌビスを通しお開瀺された他者の技術䞊、営業䞊又は経営䞊の䞀切の情報以䞋「機密情報」ずいいたす。を、その曞面による承諟なく、開瀺された目的以倖に䜿甚し、又は第䞉者に察しお提䟛、開瀺若しくは挏掩しおはなりたせん。

2.䌚員は、機密情報を本サヌビスの提䟛・改善のため必芁のある圹職員雇甚契玄、委任契玄又は業務委蚗契玄等の契玄圢態を問わず自己の業務に埓事する者をいいたす。、共同研究者、業務委蚗先、倖郚アドバむザヌ等であっお機密保持矩務を負う者にのみ開瀺できるものずし、か぀開瀺目的以倖の目的には䜿甚しないものずしたす。

3.䌚員が本芏玄に基づき機密情報を開瀺した堎合であっおも、䌚員はその管理に関する䞀切の責任を免れるこずはできず、開瀺先、委蚗先に本芏玄に機密情報を厳重に管理させる責任を負いたす。

4.䌚員は、本サヌビスの終了、本契玄の解玄その他の事由により本契玄が終了した堎合、機密情報を速やかに返還又は廃棄したす。廃棄にあたっおは、機密情報を再利甚できない方法をずるものずしたす。

5.前項の返還又は砎棄の際に圓瀟の指瀺があったずきは、䌚員はその指瀺に異議なく埓うものずしたす。䌚員は、機密情報を砎棄した堎合においお、圓瀟が求めた堎合は、機密情報を砎棄したこずを蚌する曞面を圓瀟に察し速やかに亀付するものずしたす。

第 18 条情報発信による責任・第䞉者ずの玛争

1.䌚員は、本サヌビスを通じお自らが発信した情報ナヌザヌ又は蚀語サヌビスセンタヌに察する連絡内容を含みたすが、これに限られたせん。以䞋本条においお同じ。に぀き䞀切の責任を負うものずし、圓瀟に䜕等の損害又は負担を䞎えないものずしたす。䞇が䞀圓瀟に損害又は負担が発生した堎合、䌚員は、圓瀟に生じた損害又は負担のすべおを盎ちに賠償又は補償するものずしたす。

2.䌚員は、本サヌビスの利甚に関連しお、䌚員が第䞉者に察しお損害を䞎えた堎合、たたは䌚員が第䞉者ず玛争を生じた堎合、圓該䌚員は自己の費甚ず責任で解決するものずし、圓瀟に䞀切損害又は負担を䞎えないものずしたす。䞇が䞀圓瀟に損害又は負担が発生した堎合、䌚員は、圓瀟に生じた損害又は負担のすべおを盎ちに賠償又は補償するものずしたす。

3.圓瀟は、法什䞊びに本芏玄及び個別芏玄の遵守状況等を確認する必芁がある堎合、䌚員が自ら発信した情報の内容を確認するこずができたす。ただし、同時に、圓瀟はそのような確認を行う矩務を䌚員に察しお負うものではありたせん。

第 19 条犁止事項

1.圓瀟は、䌚員等による本サヌビスの利甚に際しお、以䞋の各号に定める行為を犁止したす。

(1)法什条䟋を含みたす。、裁刀所の刀決、決定若しくは呜什又は法什䞊拘束力のある行政措眮に違反する行為

(2)圓瀟、圓瀟がラむセンスを受けおいるラむセンサヌその他第䞉者の知的財産暩、特蚱暩、実甚新案暩、意匠暩、商暙暩、著䜜暩、肖像暩等の財産的又は人栌的な暩利を䟵害する行為又はこれらを䟵害するおそれのある行為

(3)圓瀟が蚱諟した方法以倖で、本サヌビス又は本サヌビスに掲茉された情報・サヌビスを自らたたは第䞉者を利甚しお商業(営利) 目的で利甚する行為

(4)䞍圓に他人の名誉や暩利、信甚を傷぀ける行為又はそのおそれのある行為

(5)公序良俗に反する行為若しくはそのおそれのある行為又は公序良俗に反するおそれのある情報を他の䌚員又は第䞉者に提䟛する行為

(6)犯眪行為、犯眪行為に結び぀く行為若しくはこれを助長する行為又はそのおそれのある行為

(7)営利性の有無にかかわらず営業、宣䌝、広告及び勧誘をする行為、宗教掻動及び宗教団䜓ぞの勧誘行為、性行為及びわいせ぀な行為を目的ずする行為、面識のない異性ずの出䌚い及び亀際を目的する行為、第䞉者に察する嫌がらせ及び誹謗䞭傷を目的ずする行為䞊びに差別的な行為及びそれらを助長する行為その他の本サヌビスが予定しおいる利甚目的ず異なる目的で本サヌビスを利甚する行為

(8)本サヌビス䞊で、事実に反する情報、事実に反するおそれのある情報又は䞍正確な情報を登録し又は圓瀟若しくは第䞉者に提䟛する行為

(9)圓瀟のシステムぞの䞍正アクセス、それに䌎うプログラムコヌドの改ざん、䜍眮情報を故意に虚停、通信機噚の仕様その他アプリケヌションを利甚しおのチヌト行為、コンピュヌタヌりィルスの頒垃その他本サヌビスの正垞な運営を劚げる行為又はそのおそれのある行為

(10)マクロ及び操䜜を自動化する機胜やツヌル等を䜿甚する行為

(11)クロヌラヌ、スパむダヌ及びこれらに類䌌するプログラムや凊理技術等を甚いお本サヌビスの情報を取埗する行為

(12)改倉、逆コンパむル、逆アセンブル、リバヌス゚ンゞニアリングその他゜ヌスコヌドを解析する行為

(13)同䞀又は類䌌の内容を䞍特定倚数の第䞉者に送信する行為

(14)本サヌビスのシステム等に過床な負荷をかける行為

(15)本サヌビス䞊の情報やテキスト、画像その他のコンテンツを改ざん・消去する行為

(16)圓瀟若しくは第䞉者になりすたす行為又は意図的に虚停の情報を流垃させる行為

(17)第䞉者の個人情報、登録情報、利甚履歎情報などを䞍正に取埗、収集、開瀺又は提䟛する行為

(18)本サヌビスの運営を劚害する行為、信甚の毀損又は財産暩の䟵害等の圓瀟又は第䞉者に䞍利益又は損害を䞎える行為又はそれらのおそれのある行為

(19)圓瀟が本サヌビス䞊で提䟛する情報・サヌビスを䞍正の目的をもっお利甚する行為

(20)青少幎の心身及びその健党な育成に悪圱響を及がすおそれのある行為

(21)他の䌚員のアカりントの䜿甚その他の方法により、第䞉者になりすたしお本サヌビスを利甚する行為

(22)同䞀の䌚員が耇数の䌚員登録を行う行為

(23)詐欺、芏制薬物の濫甚、預貯金口座及び携垯電話の違法な売買等の犯眪に結び぀く又は結び぀くおそれのある行為

(24)犯眪収益に関する行為、テロ資金䟛䞎に関する行為又はその疑いがある行為

(25)未成幎者、未成幎被埌芋人、成幎被埌芋人、被保䜐人又は被補助人である䌚員が、民法䞊有効な法埋行為を行うために必芁な法定代理人の代理又は事前の同意によらずに本サヌビスを利甚する行為

(26)異性ずの亀流を図る目的、恋愛関係を構築するための目的又は性的な目的で、本サヌビスを利甚する行為

(27)他者圓瀟を含みたす。に察する暎蚀、䟮蟱、誹謗䞭傷、人栌吊定、その他のハラスメントにあたる行為又は脅迫的蚀動暩利がある堎合でもその請求の態様が瀟䌚通念䞊盞圓性を欠く堎合を含みたすが、これに限られたせん。

(28)圓瀟に察しお類䌌又は同様の問合せを必芁以䞊に繰り返す等圓瀟に察しお䞍圓な芁求をする行為その他圓瀟による本サヌビスの運営若しくは第䞉者による本サヌビスの利甚を劚害し又はこれらに支障を䞎える行為

(29)䞊蚘各号のいずれかに該圓する行為を揎助又は助長する行為

(30)その他圓瀟が䞍適圓ず刀断する行為

2.前項の犁止行為に該圓するか吊かの刀断は、圓瀟の裁量により行うものずし、圓瀟は刀断基準に぀いお説明責任を負わないものずしたす。

3.圓瀟は、䌚員等の行為が、第項各号のいずれかに該圓するず刀断した堎合、事前に通知するこずなく、以䞋の各号のいずれか又は党おの措眮を講じるこずができるものずしたす。

(1)䌚員資栌の抹消・陀名凊分

(2)本サヌビスの利甚資栌の停止凊分

(3)その他圓瀟が必芁ず刀断する行為

4.前項の措眮により䌚員等に生じた損害に぀いお、圓瀟は䞀切の責任を負わないものずしたす。

第 20 条䌚員等の責任

1.䌚員等は、䌚員等自身の責任においお本サヌビスを利甚するものずし、本サヌビスにおいお行った䞀切の行為及びその結果に぀いお䞀切の責任を負うものずしたす。

2.䌚員等は、本サヌビスの利甚に関連しお本芏玄に違反し又は故意若しくは過倱によっお圓瀟に損害を䞎えた堎合、圓瀟に発生した損害逞倱利益及び匁護士費甚を含みたす。の䞀切を賠償するものずしたす。

3.前項の堎合、䌚員等は、圓瀟の信甚回埩に必芁な措眮等を無償で講ずるものずしたす。

4.䌚員等は、本利甚芏玄に基づく金銭債務の履行を怠ったずきは、圓瀟に察し幎率14.6の割合1幎を365日ずする日割蚈算による遅延損害金を支払うものずしたす。

5.前項の芏定は、䌚員の退䌚又は陀名埌も効力を有するものずしたす。

第 21 条知的財産暩等

1.本サヌビスにおいお提䟛される党おの情報及びコンテンツ以䞋総称しお「本サヌビスコンテンツ」ずいいたす。に関する著䜜暩、特蚱暩、実甚新案暩、商暙暩、意匠暩その他䞀切の知的財産暩及びこれらの暩利の登録を受ける暩利以䞋総称しお「知的財産暩」ずいいたす。は、圓瀟又は圓瀟がラむセンスを受けおいるラむセンサヌに垰属し、䌚員には垰属しないものずしたす。

2.䌚員は、本サヌビスの利甚によっお、前項に定める暩利に぀き䜕らの暩利の付䞎も受けるものではありたせん。

3.䌚員は、方法又は圢態の劂䜕を問わず、著䜜暩法で認められる範囲を超えお、本サヌビスコンテンツを䜿甚、耇補、改倉、翻蚳、転茉、公開、配信又は譲枡、䜿甚蚱諟その他䞀切の利甚又は凊分以䞋「利甚等」ずいいたす。を行うこずはできないものずしたす。

4.䌚員は、圓瀟が本サヌビス及び提携サむトにおいお以䞋の各号に定める行為を無償で行う暩利を圓瀟に察しお事前に蚱諟するものずしたす。

(1)物件情報の党郚たたは䞀郚が衚瀺される画面においお、本サヌビスにより提䟛されおいる旚の衚蚘ならびに圓瀟サむトぞのリンクを蚭定する暩利

(2)物件情報掲茉画面においお、圓瀟又は第䞉者の広告又は蚘事を掲茉する暩利

(3)その他、物件情報掲茉画面においお圓瀟が遞定する任意のコンテンツを衚瀺する暩利

(4)本サヌビスの広告・宣䌝、利甚促進の目的のため、物件情報掲茉画面、䌚員向けのメヌル、広告又はプレスリリヌスにおいお、圓瀟が任意に遞定した物件情報、蚘事等の党郚たたは䞀郚を掲茉、匕甚、芁玄玹介する暩利

(5)圓瀟が任意に遞定した物件情報を圓瀟提携サむトに衚瀺する暩利

5.䌚員が本条の芏定に違反しお第䞉者ずの玛争が生じた堎合、䌚員は自己の費甚ず責任においお圓該問題を解決するずずもに、圓瀟に䜕らの䞍利益、負担又は損害を䞎えないよう適切な措眮を講じなければならず、圓瀟がその解決のために協力を求めた堎合は、これに無償で応じなければならないものずしたす。

6.䌚員は、䌚員が本サヌビス䞊においお提䟛、掲茉、投皿する物件情報、意芋、問合せ、メヌル、コメント、図面、画像その他のコンテンツ・情報以䞋「掲茉コンテンツ」ずいいたす。に関しおは、発生しうる党おの著䜜暩著䜜暩法第27条及び第28条に定める暩利を含みたす。を無償にお圓瀟圓瀟が指定する者がいる堎合はその者。以䞋本条においお同じ。に譲枡し、掲茉コンテンツに぀いお、圓瀟が目的を問わず無制限に利甚等ができるものずしたす。圓瀟は、掲茉コンテンツが本芏玄に違反するず刀断した堎合、掲茉コンテンツを掲茉した䌚員が退䌚又はアカりント取消・抹消ずなった堎合、その他圓瀟が本サヌビスの運営䞊必芁ず刀断した堎合、事前の通知なく圓該掲茉コンテンツを倉曎又は削陀するこずができるものずしたす。

7.䌚員は、掲茉コンテンツに぀き、圓瀟、圓瀟から暩利を承継し又は圓瀟が蚱諟した第䞉者及び圓該第䞉者から暩利を承継した者に察し、著䜜者人栌暩公衚暩、氏名衚瀺暩及び同䞀性保持暩を含みたす。を行䜿しないものずしたす。

8.䌚員は、掲茉コンテンツが第䞉者の暩利を䟵害しおいないこずを衚明か぀保蚌し、䞇䞀第䞉者から異議その他の請求があった堎合、自らの責任でこれを解決するものずしたす。

9.本条に芏定する圓瀟ず䌚員の間の暩利矩務関係に぀いおは、退䌚、アカりントの削陀その他圓該䌚員が本サヌビスの利甚を終了した埌も匕き続き有効に継続するものずしたす。䌚員が削陀しなかった掲茉コンテンツの削陀に関する刀断は、圓瀟が行うものずし、䌚員はこれに察しお䜕らの請求をし又は異議を述べるこずはできたせん。

第 22 条退䌚

1.退䌚を垌望する䌚員は、圓瀟所定の方法で退䌚を申し出るものずしたす。䌚員は、退䌚を申し出た日が属する月の翌月の末日をもっお、本サヌビスを退䌚するものずしたす。

2.圓瀟に察する債務が存する䌚員は、退䌚時たでにその䞀切を粟算するものずしたす。

3.退䌚により䌚員に本サヌビスを利甚できない期間が生じた堎合であっおも、圓瀟は退䌚した䌚員に察し、掲茉料等所定の料金の枛額䞊びに既玍の料金及びその他の費甚の返還を䞀切行いたせん。

4.退䌚埌、圓瀟は、䌚員が䜜成したアカりントに関する䞀切の暩利を取埗するものずしたす。

5.退䌚埌、圓瀟は、䌚員が投皿、掲茉した物件情報その他のコンテンツの著䜜暩に関する䞀切の暩利を取埗するものずしたす。

6.退䌚時、䌚員が、本サヌビスに基づき、圓瀟に察しお支払うべき利甚料等の察䟡の支払矩務を負う堎合、圓該支払矩務は、圓該退䌚により消滅せずに存続するものずしたす。

7.退䌚により、䌚員が圓該退䌚たでに有しおいた本サヌビスのポむント等の特兞の䞀切は消滅するものずしたす。

第 23 条芏玄違反等に察する措眮

1.圓瀟は、䌚員が本芏玄又は個別芏玄に違反し若しくはそのおそれがある堎合、䌚員による本サヌビスの利甚に関し第䞉者から異議、クレヌムがなされた堎合又は䌚員による本サヌビスの利甚に䞍適切な事情が存するず圓瀟においお思料する堎合においお、圓瀟が必芁ず認めるずきは、䌚員に察し、予め通知するこずなく、次の各号の措眮を講じるこずができるものずしたす。本条に基づく措眮を講じた堎合であっおも、これによる結果に関し、圓瀟は䞀切の責任を負わないものずしたす。

(1)本芏玄又は個別芏玄に違反する行為又はそのおそれのある行為の党郚又は䞀郚の停止芁請

(2)第䞉者からの異議、クレヌムぞの適切な察凊ずしお圓瀟が指定する行為の芁請

(3)投皿コンテンツの削陀芁請

(4)投皿コンテンツの党郚若しくは䞀郚の削陀又は合理的な加工凊理第䞉者が閲芧できない状態ずするこずを含みたす。

(5)アカりントの抹消・陀名凊分又は本サヌビスの利甚資栌の停止凊分

(6)その他圓瀟が適切ず合理的に刀断する措眮

2.前項の芏定によっおも、圓瀟は、䌚員に察しお、特定の䌚員に察し前項の措眮を講じる矩務を負わないものずしたす

第 24 条陀名、利甚資栌の停止等

3.圓瀟は、䌚員が以䞋の各号のいずれかに該圓するず圓瀟においお刀断した堎合、䜕らの通知をするこずなく、䌚員の陀名凊分又は䌚員資栌の停止をするこずができるものずしたす。

(1)実圚しない堎合

(2)圓瀟に届け出られた連絡先情報を通じお䌚員ず連絡がずれないずき

(3)登録情報に虚停の情報が含たれおいる堎合

(4)料金等の支払債務の履行遅延たたは䞍履行が䞀床でもあった堎合

(5)宅地建物取匕業の免蚱を喪倱し、又は業務停止その他の行政凊分を受け、若しくは聎聞の公瀺がなされた堎合

(6)䞍動産公正取匕協議䌚連合䌚が定める、䞍動産の衚瀺に関する公正競争芏玄、䞍動産業における景品類の提䟛の制限に関する公正競争芏玄に違反しお、譊告等の措眮を受けたずき

(7)第䞉者に振り出した手圢又は小切手が䞍枡りずなったずき

(8)砎産、民事再生、䌚瀟曎生、特別枅算等の申立おを受け、又は自ら申し立おたずき、あるいは枅算を開始したずき

(9)過去に圓瀟からアカりントの抹消・陀名凊分又は利甚資栌の䞀時停止等の凊分を受けおいた堎合

(10)䌚員資栌の取消又は利甚制限がされた者ず実質的に同芖できる法人又は自然人である堎合

(11)䌚員の盞続人等から圓該䌚員が死亡した旚の連絡があった堎合又は圓瀟が圓該䌚員の死亡の事実を確認できた堎合

(12)䌚員たたは䌚員の勀務先その他の関係者が反瀟䌚的勢力に属するなど、反瀟䌚的勢力ずの䞍適切な関係を有し、たたはその合理的疑いがある堎合

(13)前条第項に芏定する圓瀟からの芁請を受けたにもかかわらず速やかに期限が指定されおいた堎合は圓該期限内にこれに応じない堎合

(14)その他本芏玄に定める遵守事項、犁止事項その他の本芏玄の芏定に違反したずき又は䌚員ずしお䞍適圓な堎合

4.前項各号に定める堎合のほか、圓瀟は、䌚員に察しお14日前たでに事前に通知するこずにより、本契玄を任意に解玄し、退䌚又は利甚制限をさせるこずができるものずしたす。

5.前二項の措眮により䌚員に生じた損害に぀いお、圓瀟は䞀切の責任を負わないものずしたす。

6.第1項及び第2項の措眮により退䌚した䌚員は、退䌚時に期限の利益を喪倱し、盎ちに、圓瀟に察し負担する党おの債務を、圓瀟が指定する方法で䞀括しお履行するものずしたす。なお圓瀟は、既に支払われた料金等の払戻しは䞀切いたしたせん。

7.退䌚凊分を受け若しくは䌚員資栌を取り消された䌚員又は本サヌビスの利甚を制限された䌚員に察し、圓瀟は本サヌビスの提䟛を盎ちに停止するものずしたす。

第 25 条本サヌビスの倉曎・停止等

1.圓瀟は、䌚員等に事前に通知するこずなく、本サヌビスの名称・内容等仕様、手順、现則、デザむン、芖聎芚効果・衚珟を含みたすが、これに限られたせん。の党郚又は䞀郚を任意の内容に倉曎し、たた、その提䟛を䞭止するこずができるものずしたす。

2.圓瀟は、前項の倉曎又は䞭止によっお、埓前の本サヌビスの機胜・性胜が維持されるこずを保蚌するものではありたせん。

3.圓瀟は、以䞋のいずれかに該圓する堎合には、本サヌビスの利甚の党郚又は䞀郚を停止又は䞭断するこずができるものずしたす。この堎合においお、圓瀟は䌚員に察しお、できる限り事前に通知するよう努めるものずしたすが、事前の通知を保蚌するものではありたせん。

(1)火灜、停電、疫病、倩灜地倉等の䞍可抗力により本サヌビスの運営ができなくなった堎合

(2)本サヌビスの運営に必芁な蚭備、ハヌドり゚ァ、゜フトりェアその他の環境に障害が発生し、又は発生する恐れがあるずき

(3)本サヌビスに係るコンピュヌタヌ・システムの点怜又は保守䜜業を定期的又は緊急に行う堎合

(4)コンピュヌタヌ、通信回線等が事故により停止した堎合

(5)法什又は叞法機関若しくは行政機関の刀断に基づき芁請された堎合

(6)その他、圓瀟が本サヌビスの停止又は䞭断すべきず刀断した堎合

4.圓瀟は、前項の芏定による本サヌビスの停止により䌚員等が被った損害に぀き䞀切の責任を負いたせん。

第 26 条本サヌビスの廃止

　　圓瀟は、本サヌビスの党郚又は䞀郚をい぀でも廃止するこずができるものずしたす。

第 27 条個人情報の取り扱い

1.圓瀟は、個人情報に぀いお、圓瀟が別途定めるプラむバシヌポリシヌ以䞋「プラむバシヌポリシヌ」ずいいたす。に則り、適正に取り扱うこずずしたす。

2.圓瀟は、本サヌビスに入力されたデヌタに個人情報が含たれおいた堎合、これを本サヌビス提䟛以倖の目的で利甚しないものずし、個人情報の保護に関する法埋及びプラむバシヌポリシヌに基づいお、玛倱・砎壊・改竄・挏掩等の危険から保護するための合理的な安党管理措眮を講じ、厳重に管理するものずしたす。

3.圓瀟は、本サヌビスの提䟛のため必芁がなくなった個人情報に関しお、圓瀟責任の䞋で速やかに砎棄するものずしたす。

第 28 条免責・責任限定

1.圓瀟は、本サヌビスにおいお、䞀般ナヌザヌ及び䌚員ずの間における䞍動産取匕の堎を提䟛するものです。本サヌビスにおける䞍動産取匕に関する契玄はナヌザヌ及び䌚員の間においお成立し、圓瀟は契玄圓事者にはなりたせん。たた、圓瀟は、本芏玄に別に芏定する堎合を陀き、䌚員が行う䞍動産取匕、仲介等に関し、代金の支払、返金、その他取匕の遂行に䞀切関䞎したせん。

2.圓瀟は、本サヌビス及びその内容に事実䞊又は法埋䞊の瑕疵、䞍具合完党性、正確性、安党性、有効性及び特定の目的ぞの適合性などに関する欠陥、゚ラヌ若しくはバグ又は暩利䟵害等を含みたす。がないこずに぀いお、明瀺的にも黙瀺的にも䞀切の保蚌をしおおりたせん。圓瀟は、䌚員に察し、かかる瑕疵を陀去しお本サヌビスを継続的に提䟛する矩務を負いたせん。

3.圓瀟は、本サヌビスに起因しお䌚員に生じたあらゆる損害盎接、間接、特別、掟生、結果 障害、逞倱利益、営業機䌚の損倱、デヌタの損倱又は消倱等に関する損害を含みたす。に぀いお䞀切の責任を負いたせん。ただし、本サヌビスに関する圓瀟ず䌚員の契玄本芏玄を含みたす。が消費者契玄法に定める消費者契玄ずなる堎合は、この限りではありたせん。

4.前項ただし曞きの堎合であっおも、圓瀟は、圓瀟の過倱重過倱を陀きたす。による債務䞍履行又は䞍法行為により䌚員に生じた損害のうち特別な事情から生じた損害圓瀟又は䌚員が損害発生に぀き予芋し、又は予芋し埗た堎合を含みたす。に぀いお䞀切の責任を負いたせん。たた、圓瀟がその過倱重過倱を陀きたす。による債務䞍履行又は䞍法行為により䌚員に生じた損害の賠償を行う堎合、その損害の賠償金額は䌚員が圓該損害を蒙る原因ずなったサヌビスに぀き過去幎間に圓瀟に支払った察䟡の総額を䞊限ずしたす。

5.本サヌビスの利甚に関連し、又は利甚できないこずに関連しお、䌚員盞互間若しくは䌚員ずナヌザヌその他の第䞉者ずの間で玛争が発生した堎合、圓瀟は圓該問題に䞀切関知せず、䞀切の責任を負わないものずし、これらのトラブルは、圓該䌚員が自らの費甚ず負担においお解決するものずしたす。

6.前項の堎合においお、圓該䌚員の盞手方ずなる䌚員又は第䞉者が圓瀟に察しお䜕らかの請求を行い又は蚎蚟を提起したずきは、䌚員は圓瀟が圓該第䞉者に察応するに際し、あらゆる協力を行うものずし、たた、圓該請求又は蚎蚟に関連しお圓瀟が蒙った䞀切の損害を賠償するものずしたす。 

7.䌚員は、法什の範囲内で本サヌビスをご利甚ください。本サヌビスの利甚に関連しお䌚員が日本又は倖囜の法什に觊れた堎合でも、圓瀟は䞀切の責任を負わないものずしたす。

8.圓瀟は、倩灜、地倉、火灜、ストラむキ、通商停止、戊争、内乱、感染症の流行その他の䞍可抗力により本契玄の党郚又は䞀郚に䞍履行が発生した堎合、䞀切の責任を負わないものずしたす。

9.前各項の芏定は、䌚員の退䌚又は陀名埌も効力を有するものずしたす。

第 29 条反瀟䌚的勢力の排陀

1.䌚員等は、珟圚、暎力団、暎力団員、暎力団員でなくなった時から5幎を経過しない者、暎力団準構成員、暎力団関係䌁業、総䌚屋等、瀟䌚運動等暙がうゎロ又は特殊知胜暎力集団等、その他これらに準ずる者以䞋「暎力団員等」ずいいたす。に該圓しないこず、及び次の各号のいずれにも該圓しないこずを衚明し、か぀将来にわたっおも該圓しないこずを保蚌したす。

(1)暎力団員等が経営を支配しおいるず認められる関係を有するこず

(2)暎力団員等が経営に実質的に関䞎しおいるず認められる関係を有するこず

(3)自己、自瀟若しくは第䞉者の䞍正の利益を図る目的又は第䞉者に損害を加える目的をもっおする等、䞍圓に暎力団員等を利甚しおいるず認められる関係を有するこず

(4)暎力団員等に察しお資金等を提䟛し、又は䟿宜を䟛䞎する等の関䞎をしおいるず認められる関係を有するこず

(5)圹員又は経営に実質的に関䞎しおいる者が暎力団員等ず瀟䌚的に非難されるべき関係を有するこず

2. 䌚員等は、自ら又は第䞉者を利甚しお次の各号のいずれにも該圓する行為を行わないこずを確玄したす。

(1)暎力的な芁求行為

(2)法的な責任を超えた䞍圓な芁求行為

(3)取匕に関しお、脅迫的な蚀動をし、又は暎力を甚いる行為

(4)颚説を流垃し、停蚈を甚い又は嚁力を甚いお盞手方の信甚を毀損し、又は盞手方の業務を劚害する行為

(5)その他前各号に準ずる行為

3.䌚員等が、暎力団員等若しくは第1項各号のいずれかに該圓し、若しくは前項各号のいずれかに該圓する行為をし、又は第1項の芏定にもずづく衚明・保蚌に関しお虚停の申告をしたこずが刀明した堎合には、圓瀟は、自己の責に垰すべき事由の有無を問わず、䌚員等に察しお䜕らの催告をするこずなく、本契玄を解陀するこずができ、又は䌚員の退䌚凊理若しくは䌚員等に察するサヌビス提䟛の拒吊をするこずができるものずしたす。

4.䌚員等は、前項により圓瀟が本契玄の解陀、退䌚凊理又はサヌビス提䟛の拒吊をした堎合、盞手方に損害が生じたずしおもこれを䞀切賠償する責任はないこずを確認し、これを了承したす。

第 30 条連絡・通知

1.本サヌビスに関する問い合わせその他䌚員等から圓瀟に察する連絡又は通知は、䞋蚘の問合せフォヌムから又は圓瀟が定める連絡方法で行うものずしたす。

2.圓瀟は、本サヌビスに関しお䌚員等に通知又は連絡を行う堎合には、本サヌビス又は圓瀟のりェブサむトぞの掲瀺その他圓瀟が適圓ず刀断する方法により行うものずしたす。

3.圓瀟が個々の䌚員に通知又は連絡を行う堎合には、本サヌビスにおいお䌚員登録された電子メヌルアドレス、䜏所又は電話番号に察しお行うこずにより、通知をしたものずみなされたす。圓瀟からの通知又は連絡は、圓瀟から発信されたずきにその効力が生ずるものずしたす。

第 31 条地䜍の譲枡等

1.䌚員等は、本芏玄に別段の定めがある堎合を陀き、圓瀟の曞面による事前の承諟なく、本契玄䞊の地䜍又は本芏玄に基づく暩利若しくは矩務の党郚又は䞀郚に぀き、第䞉者に察し、譲枡、移転、担保蚭定、その他の凊分をするこずはできたせん。䜆し、事業譲枡又は合䜵、䌚瀟分割その他の組織再線に぀いおはこの限りではありたせん。

2.圓瀟は、䌚員等に察する債暩を第䞉者に譲枡できるものずし、䌚員は、そのために自己の登録情報が圓該第䞉者に提䟛されるこずを承諟するものずしたす。

第 32 条委蚗

圓瀟は本サヌビスの提䟛に関する業務の党郚および䞀郚を䌚員等の承諟なしに、第䞉者に委蚗するこずができたす。この堎合においお、圓瀟は責任をもっお委蚗先を管理したす。

第 33 条分離可胜性

3.本芏玄のいずれかの条項又はその䞀郚が無効又は執行䞍胜ず刀断された堎合であっおも、圓該刀断は他の郚分に圱響を及がさず、本芏玄の残りの郚分は、匕き続き有効か぀執行力を有するものずしたす。圓瀟及び䌚員は、圓該無効若しくは執行䞍胜ずされた条項又は郚分の趣旚に埓い、これず同等の効果を確保できるように努めるずずもに修正された本芏玄に拘束されるこずに同意するものずしたす。

4.本芏玄のいずれかの条項又はその䞀郚が、ある䌚員等ずの関係で無効又は執行䞍胜ず刀断された堎合であっおも、他の䌚員等ずの関係における有効性等には圱響を及がさないものずしたす。

第 34 条準拠法及び合意管蜄

本芏玄の準拠法は日本法ずし、本芏玄に起因し又は関連する䞀切の玛争に぀いおは、東京地方裁刀所を第䞀審の専属的合意管蜄裁刀所ずしたす。

第 35 条その他

本芏玄は日本語を正文ずしたす。他の蚀語によるものは参考のために提䟛されおいるにすぎず、正文ずはなりたせん。日本語によるものの内容ず他の蚀語によるものずの内容に矛盟又は霟霬がある堎合、日本語によるものの内容が優先するものずしたす。他の蚀語によるものに芏定された内容により、日本語によるものの内容を補充たたは修正するこずはできたせん。

第 36 条協議解決

圓瀟及び䌚員等は、本芏玄に定めのない事項又は本芏玄の解釈に疑矩が生じた堎合には、互いに信矩誠実の原則に埓っお協議の䞊速やかに解決を図るものずしたす。

プラむバシヌポリシヌ・個人情報保護方針

このプラむバシヌポリシヌ以䞋、「本ポリシヌ」ずいいたす。は、株匏䌚瀟JPコンサルティング以䞋、「圓瀟」ずいいたす。が運営するむンタヌネットサむトPlatform以䞋、「本サヌビス」ずいいたす。に関連しお圓瀟が取埗する個人情報の取扱いに぀いお定めるものです。

圓瀟は、本サヌビスの運営、圓瀟サヌビスの提䟛に必芁な範囲で、本サヌビスの利甚者以䞋、「ナヌザヌ」ずいいたす。又は本サヌビスに物件情報を掲茉する方以䞋、「゚ヌゞェント䌚員」ずいいたす。から、ナヌザヌ又ぱヌゞェント䌚員以䞋、本ポリシヌにおいお、䞡者を䜵せお「お客様」ずいうこずがありたす。に係る個人情報を取埗したす。

圓瀟及び圓瀟の圹職員䞀同は、本サヌビスの運営に関しお客様から個人情報をお預かりするにあたり、個人情報を倧切に保護するこずを圓瀟の重芁な瀟䌚的䜿呜ず認識し、圹職員が個人情報保護に関する法什、指針およびその他の芏範を遵守いたしたす。

本ポリシヌずは別にお客様から個別の同意以䞋、「個別同意」ずいいたす。がある堎合は圓該個別同意の内容に埓うものずしたす。

「個人情報」ずは、個人情報の保護に関する法埋平成十五幎法埋第五十䞃号、以䞋、「個人情報保護法」ずいいたす。にいう「個人情報」を指し、生存する個人に関する情報であっお、圓該情報に含たれる氏名、生幎月日その他の蚘述等により特定の個人を識別できるもの又は個人識別笊号が含たれるものをいいたす。

2.取埗する個人情報

圓瀟が本サヌビスの提䟛にあたりお客様から取埗する個人情報は以䞋のずおりです。なお、以䞋の項目は䟋瀺であり、圓瀟が収集する情報は以䞋の項目に限られるものではありたせん。

ナヌザヌから取埗する䞻な情報

・氏名、性別、幎霢、囜籍、居䜏地、電話番号、その他の連絡先に関する情報、䜿甚蚀語等

・物件の垌望条件地域、皮類、間取り、広さ、築幎数、予算その他の垌望条件

・本サヌビス内の閲芧履歎閲芧したりェブペヌゞ、日時、回数等、怜玢条件等の行動履歎

宅建免蚱番号、氏名又は名称、代衚者名、所圚地、電話番号、担圓者名、等

・お客様から圓瀟ぞのお問合せ、ご連絡等に関する情報

・本サヌビスの利甚履歎、本サヌビスをきっかけずしたお取匕内容やお取匕履歎、商談・成玄状況等に関する情報チャットボット等本サヌビス䞊で利甚できるツヌルを利甚しおお客様が他者ず連絡をするために入力、送信したコメント、メッセヌゞを含みたす。

・お客様のむンタヌネットの利甚に関する情報圓瀟が自ら Cookieにより収集し、又は圓瀟以倖の第䞉者から提䟛を受けた、りェブサむト、怜玢キヌワヌド、広告の閲芧・クリック数に関する履歎、アクセスログ、IPアドレス、ブラりザ情報閲芧時間、関芧方法ブラりザの皮別、関芧時に利甚しおいる端末の利甚環境接続環境、キャリア情報、Cookie 情報、IP アドレス、端末の固䜓識別番号等の情報、その他お客様が圓瀟管理のサヌバヌにアクセスしたこずを契機ずしお機械的に取埗される情報

・通話蚘録録音・録画がある堎合はそれらの蚘録やメッセヌゞ情報

3.個人情報の取埗ず利甚

圓瀟は、以䞋の目的に必芁な範囲で、ご本人の個⌈情報を取埗し、取埗した情報を利甚したす。圓瀟は、以䞋の✬的の範囲を超えお個⌈情報を利✀する堎合、事前に適切な✅法でご本人からの同意を埗るものずしたす。

(1)本サヌビスを提䟛するため

(2)お客様のアカりント登録、本人認蚌のため

(3)お客様からのお問合わせ、ご意芋その他のご連絡に察応するためご本人確認を行うこずを含みたす。

(4)メンテナンス、重芁なお知らせなど圓瀟からお客様ぞの必芁に応じたご連絡のため

(5)ナヌザヌが行った資料請求、内芋垌望のお申蟌みに基づき、䞍動産業者䞍動産の暩利者又は暩利者から委蚗を受けた者で、本サヌビスに物件を掲茉しおいる䌚員を含みたす。以䞋同じ。に察し、ナヌザヌに関する情報ナヌザヌがアカりント登録時及び資料請求等のお申蟌みの際に入力した情報を含みたす。を提䟛するため

(6)ナヌザヌによる内芋・面談のお申蟌みに基づき、圓瀟提携の通蚳・翻蚳サヌビスの提䟛事業者に察し、通蚳等のサヌビスを提䟛するために必芁な範囲で個人情報アカりント情報、氏名、連絡先情報、囜籍、䜿甚蚀語その他ナヌザヌを識別するための識別子を含みたす。を提䟛するため

(7)本サヌビスの利甚履歎等を調査・分析し、その結果を本サヌビス若しくは圓瀟サヌビスの改良・改善又は新たなサヌビスの䌁画、研究又は開発に利甚するため

(8)本サヌビスの新機胜、曎新情報、キャンペヌン等及び圓瀟が提䟛する他のサヌビスのご案内電子メヌル、チラシ、その他のダむレクトメヌルの送付を含むのため

(9)本サヌビスに関するアンケヌト・取材等のご協力䟝頌や各皮むベントぞのご参加をお願いし、又はその結果などをご報告するため

(10)本サヌビス䞊で取埗したお客様の閲芧情報・Cookieに基づく情報等に関し、広告䌚瀟、シンクタンク、䞍動産業者その他の第䞉者に察し、圓瀟たたは䞍動産業者等のマヌケティング・広告宣䌝掻動のために提䟛するため※圓瀟は、本サヌビス䞊で取埗したお客様の閲芧情報・Cookieに基づく情報等により、お客様の関心、嗜奜、賌買傟向、属性等を分析し、その結果をお客様に察する情報提䟛、広告宣䌝掻動に掻甚するこずがありたす。

(11)本サヌビスの利甚状況等の情報を統蚈情報ずしお又は個人を特定できずか぀埩元できないような圢匏に加工した䞊で、利甚し又は広告䌚瀟、調査機関、シンクタンク、䞍動産業者その他の第䞉者に提䟛するため

(12)本サヌビス芏玄違反、䞍正行為の予防、防止、怜出、これらぞの譊告その他の察応のため

(13)その他、圓瀟・圓瀟グルヌプ䌚瀟ずナヌザヌ又ぱヌゞェント䌚員ずの取匕、圓瀟提携事業者ずの連絡を適切か぀円滑に履行するため

4.第䞉者ぞの提䟛

圓瀟は、次に掲げる堎合を陀き、ご本人の同意を埗るこずなく個人情報を第䞉者に提䟛するこずはありたせん。

(1)人の生呜、身䜓又は財産の保護のために必芁がある堎合であっお、本人の同意を埗るこずが困難である堎合

(2)公衆衛生の向䞊又は児童の健党な育成の掚進のために特に必芁がある堎合であっお、本人の同意を埗るこずが困難である堎合

(3)囜の機関若しくは地方公共団䜓又はその委蚗を受けた者が法什の定める事務を遂行するこずに察しお協力する必芁がある堎合であっお、本人の同意を埗るこずにより圓該事務の遂行に支障を及がすおそれがある堎合

(4)業務を円滑に遂行するため、利甚目的の達成に必芁な範囲内においお個人情報の取扱いの党郚又は䞀郚を委蚗する堎合

(5)合䜵その他の事由による事業の承継に䌎っお個人情報が提䟛される堎合

(6)個人情報を特定の者ずの間で共同しお利甚する堎合であっお、その旚䞊びに共同しお利甚される個人情報の項目、共同しお利甚する者の範囲、利甚する者の利甚目的及び圓該個人情報の管理に぀いお責任を有する者の氏名又は名称に぀いお、あらかじめ本人に通知し、又は本人が容易に知り埗る状態に眮いた堎合

5.安党管理

圓瀟は、その取り扱う個人情報ぞの䞍正アクセス、個人情報の玛倱、滅倱、き損、改ざん及び挏えい等のリスクの予防及び是正に関する察策その他の個人情報の安党管理のために必芁な措眮を講じたす。

6.個人情報の利甚目的の倉曎

圓瀟は、前項で特定した利甚目的は、本人の同意を埗た堎合を陀くほか、原則ずしお倉曎したせん。ただし、倉曎前の利甚目的ず盞圓の関連性を有するず合理的に認められる範囲においお、予め倉曎埌の利甚目的を公衚の䞊で倉曎を行う堎合はこの限りではありたせん。

7.個人情報の取扱いの委蚗等

圓瀟は、個人情報の取扱いの党郚又は䞀郚を第䞉者に委蚗する堎合がありたす。この堎合、圓瀟は、委蚗先ずしおの適栌性を十分に審査するずずもに、契玄にあたっお守秘矩務に関する事項等を定め、委蚗先に察する必芁か぀適切な監督を行いたす。

圓瀟は、取埗個人情報の党郚又は䞀郚を、個人情報保護法の定めに基づいお共同利甚するこずがありたす。

8.匿名加工情報

圓瀟は、お客様の個人情報を元に、特定の個人を識別するこずができないように加工しお埗られる情報であっお、元の個人情報を埩元するこずができないようにしたもの以䞋、「匿名加工情報」ずいいたす。を䜜成し、第䞉者に提䟛したす。圓瀟は、匿名加工情報を取り扱うに圓たっおは、匿名加工情報の䜜成に甚いられた個人情報に係る本人を識別する行為及び圓該匿名加工情報を他の情報ず照合する行為を行いたせん。

圓瀟は、匿名加工情報を䜜成したずきは、䜜成埌遅滞なく、䜜成した匿名加工情報に含たれる情報の項目を公衚したす。

圓瀟は、匿名加工情報を第䞉者に提䟛する堎合には、提䟛しようずする匿名加工情報に含たれる個人に関する情報の項目ず提䟛の方法を公衚するずずもに、提䟛先ずなる第䞉者に察しお、提䟛する情報が匿名加工情報であるこずを明瀺したす。

圓瀟は、匿名加工情報を取り扱うに圓たっおは、匿名加工情報の䜜成に甚いられた個人情報に係る本人を識別する行為及び圓該匿名加工情報を他の情報ず照合する行為を行いたせん。

9.個人情報の取扱いの改善・芋盎し

圓瀟は、個人情報の取扱い、管理䜓制及び取組みに関する点怜を実斜し、継続的に改善・芋盎しを行いたす。

10.個人情報の開瀺

圓瀟は、ご本人から個人情報の開瀺を求められたずきは、圓瀟所定の手続きに埓いなお、䞀定の本人確認手続等圓瀟所定の手続の履践及び手数料等の負担が必芁になるこずがありたす。、ご本人に察し、本人確認埌遅滞なくこれを開瀺したす。ただし、開瀺するこずにより次のいずれかに該圓する堎合は、その党郚又は䞀郚を開瀺しないこずもあり、開瀺しない決定をした堎合には、その旚をご本人に通知したす。

(1)ご本人又は第䞉者の生呜、身䜓、財産その他の暩利利益を害するおそれがある堎合

(2)圓瀟の業務の適正な実斜に著しい支障を及がすおそれがある堎合

(3)その他法什に違反するこずずなる堎合

11.個人情報の蚂正・削陀等

圓瀟の保有する個人情報が誀った情報である堎合には、ご本人の請求により、圓瀟が定める手続きに埓いなお、䞀定の本人確認手続等圓瀟所定の手続の履践及び手数料等の負担が必芁になるこずがありたす。、個人情報の蚂正又は削陀を行いたす。

圓瀟は、個人情報の利甚目的に照らしその必芁性が倱われたずきは、個人情報を消去又は廃棄するものずし、圓該消去及び廃棄は、倖郚流倱等の危険を防止するために必芁か぀適切な方法により、業務の遂行䞊必芁な限りにおいお行いたす。

圓瀟は、本ポリシヌに定める利甚目的の達成のための必芁性、ナヌザヌずの継続した関係性がある期間の長さ、法埋䞊の矩務の有無、ナヌザヌが圓事者ずなっおいる契玄を履行する必芁があるか吊か等を基準ずしお、個人情報の保有期間を決定したす。

12.保有個人デヌタ等の開瀺等、蚂正等、利甚停止等の手続きに぀いお

ナヌザヌは、圓瀟所定の手続に埓い、ご本人が識別される保有個人デヌタの利甚目的の通知、保有個人デヌタ又は第䞉者提䟛蚘録の開瀺、保有個人デヌタの内容の蚂正・远加・削陀、保有個人デヌタの利甚の停止・消去・第䞉者提䟛の停止を求めるこずができたす。なお、䞀定の本人確認手続等圓瀟所定の手続の履践及び手数料等の負担が必芁になるこずがありたす。

13.個人情報の利甚停止等

圓瀟は、ご本人から、個人情報が、利甚目的の範囲を超えお取り扱われおいるずいう理由、又は䞍正の手段により取埗されたものであるずいう理由により、その利甚の停止又は消去以䞋、「利甚停止等」ずいいたす。を求められた堎合には、必芁な調査を行い、その結果に基づき必芁ず刀断した堎合は、個人情報の利甚停止等を行い、その旚ご本人に通知したす。ただし、個人情報の利甚停止等に倚額の費甚を有する堎合その他利甚停止等を行うこずが困難な堎合であっお、ご本人の暩利利益を保護するために必芁なこれに代わるべき措眮をずれる堎合は、この代替策を講じるものずしたす。

圓瀟は、お客様のプラむバシヌの保護、本サヌビス・圓瀟サヌビスの利䟿性の向䞊、広告の配信および統蚈情報の取埗等のため、Cookieお客様がWebサむトにアクセスした際にWebサヌバヌからWebブラりザに送信され、お客様のデバむスの内蔵ストレヌゞに保存されるテキストファむルのこずをいいたす。ナヌザヌが特定のWebサヌビスを利甚する際に、WebサヌバヌがCookieを参照するこずで自動的にお客様のデバむスを識別し、お客様が同じ情報を繰り返し入力するこずなく圓該Webサむトを䟿利に利甚するこずができたす。を䜿甚する堎合がありたす。お客様は、Webブラりザ䞊の蚭定により、Cookieを䜿甚しおいるWebサむトであるこずを衚瀺するこずができ、たた、Cookieを無効化又は削陀をするこずができたす。

本サヌビスの目的は、日本囜に所圚する䞍動産のお取匕に䞖界䞭の方がアクセスするこずにあり、本サヌビスは䞖界䞭の方が利甚可胜です。それゆえ、お客様の個人情報は、日本囜にあるか、お客様が本サヌビスを通じお関䞎する䞍動産取匕の盞手方、䞍動産取匕を仲介、サポヌト、関䞎をする第䞉者通蚳サヌビスの提䟛者、決枈サヌビスの提䟛者を含みたす。が所圚する日本囜倖の法域にある第䞉者がアクセスする堎合がありたす。こうした法域には、お客様が居䜏する囜又は地域のデヌタ保護法ずは異なる法埋が存圚する可胜性があり、堎合によっおは、お客様が居䜏する囜又は地域のデヌタ保護法よりも包括的ではなく、保護が十分でない可胜性がありたす。圓瀟は、お客様の個人情報が本ポリシヌに蚘茉されたずおりに、か぀適甚されるデヌタ保護法に埓っお取り扱われるこずを確保するため、適切な措眮を講じるよう努めるものずしたす。

- 銀行振蟌手数料: 貎瀟でのご負担をお願いいたしたす。

- お支払期日 : 原則、毎月末締め翌月末払いずなりたす。
